How to correct ignorance to HOS rules.

    We have a family co. I am dealing with 2 persons that seem to be ignorant to the HOS rules and how they are applied every day. 1 holds a cdl but has never had any formal training on how to fill out a log book. The other is an office manager who has never held a cdl and seems to be having a poor grasp of how the rules apply to drivers. Is is on an ELD exempt truck that I use the Keep Truckin elog book.

    Example:

    Friday
    12:14pm On duty for pre-trip inspection.

    12:35pm Driving. Dh to get fuel.

    1:22pm On duty. Fueling.

    1:40pm. Driving. Dh to pick up

    3:45pm On duty. arrive at pick up. Talk to guy in charge and park

    3:55pm. Off duty waiting for crew to begin loading my truck. Sit in truck for awhile, then get out amd watch them finish loading the trailer.

    5:56pm. Driving. Take load to Dallas.

    9:45pm. On duty arrive at drop off. Make a phone call to contact on site that I am early. Someone will be there shortly to unload me.

    9:56pm. Off duty. Park the truck and wait. Crew shows up and unloads my truck while I am laying down in my sleeper. When finished, guy walks up and hands me my signed bol.

    10:56pm. Driving to next pick up location for AM pick up.

    11:17pm. Sleeper birth/Off Duty. Parked at location.

    Before I go any further does anyone see anything wrong with my logbook?

    Because I am being told that I am not allowed to go off duty at all once I start my 11/14 clock. Any personal time is to be logged on duty. Sitting in the truck waiting to be loaded or unloaded is supposed to be on duty.

    When I try to explain, I am being told that Im wrong.

    Lawfully you are fine. Your company may decide sitting waiting to be loaded is to be shown as on duty. Now if you are helping load or on the dock or tarping and calling it line 1 or 2 that's a no no. But if you're legitimately in the sleeper then yes you can mark sleeper.

    Watching someone load your trailer isn't off duty, that's on duty not driving.

    Technically ( legally) speaking you can only use off duty if driver is released from all responsibility to the truck and is free to do as he or she pleases.

    The easiest way to go about this at the customer is to log:
    On Duty for the time it takes to check in.
    Then log sleeper berth while getting loaded it's perfectly legal.

    If driver needs to be on the dock counting freight then ( legally) that's on duty not driving.

    You can go off duty anytime you want during the 11/14 hr. clock if you are relieved of any responsibilities. It can be used to save hours on the clock for later use. You can be on duty as long as you want after the 14 hr. clock is used up, you can not drive any until a full break is taken unless it is a safety move now but I would be very careful with that and not have it abused or they might take that away.

    All time spent at commercial property is to be on duty. (Loading, unloading, etc.)

    It's In the fmcsa rules and has been posted on here a few times.

    There's extras in the rules.
    And maybe something to allow for off duty. Been awhile since it was posted.

    Someone would have to post it. I'm not looking for it.

    There is no such rule. The closet there is all time supervising the loading/unloading of the cmv.

    Print it out and leave it on thier desks.

    But, it's thier company, they do what they want.

    Then it should not be too hard for you to find it and post it.
    Simply being on property does not mean one has to be on duty.
