Can my Company fine me 1000$ for being out of service

    $1000 for a tire leaking air? Two brakes out of adjustment? Inoperative brake lamps? Sounds more than fair.:rolleyes:

    Those are the questions I have already presented, with the said contractor. I am trying to get a response in the area of getting a better contract written. The Escrow is also a little strange to me.

    I’ll be rational here. It’s a sucker deal, he probably won’t fix the equipment you write up. Then if you get a violation, he uses your money to fix it and pockets the rest. Tell him to pound sand, or give you a credit card for repairs, purchasing items like lights, mudflaps, etc out on the road.

    He wouldn’t pay $1000 for any OOS equipment issues beside maybe a couple tires, so he is ripping you off. Most fines are overweight issues.

    Thank you Shogun, that's what I was really looking for.

    I thought that maybe i was being dinged for possibly being late with load and that was a way for them to make up for lost time. It was the only reasonable explanation i could come up with.

    Unfortunately a lot of shady companies will set up a fake escrow account to make the driver pay for company expenses. I say fake escrow as it's usually simply a loan to the company with no actual escrow company (3rd party) involved.
    They use it anywhere from charging the employees for maintenance (lights, brakes, etc) to damage, to even truck recovery if abandoned.

    Go park the truck and some deep mud, then let them know where you left the truck and tell him the job is just not for you.

    Actually would not surprise me that an owner like that would be..
    "Congrats on the clean level 1, you now owe the company $1,000 as the load will be late from you having the hour long inspection that was not factored in the already too tight appointment times."

    When I deal with a business, lets say a car dealership, & I see I have concerns, something just doesn't sound right &/or there are no negotiations, I have a little saying that I use.

    "There's too much competition out there for me to have to beg you to work with me."

    Then I walk away & go to a different dealer/business. Trucking companies are no different. After being a member of this forum for several years, I find I am blessed to have the little tater job I have with a small family owned company that doesn't hassle me.

    This is my best advice to you.
