Even if it's 1099 job it's absurd and under no circumstances would I agree to this. Fines for failed inspections are kind of fair IMO as long as the company you work for is honest.The one I work for charges $200 for 1st failed and $400 for 2nd if it's obvious that I should had noticed problem during pretrip.
I was once put OOS on lvl 1 because inspector found a small bubble on one of brake hoses right by brake chamber.I wasn't charged.They also pay $200 for every passed inspection regardless of level.
I never agreed to any escrow though and never will.

That contract smells really bad to me. I would cut and run. Chalk it up as a learning experience. Even if you lose money on the way out, you'll be better off in the long run. JMO

As someone that did both Drive a way as well as repos I am well aware of working as a "contractor". Some company's have discontinued the practice of escrows and some have reduced the amounts required. If you are a company driver I would never accept such a contract. However as a percentage contractor it is difficult to avoid.
Because you are NOT an employee in most 1099 operations the normal employer/employee state laws don't generally apply. You are operating more in a business relationship. Without speaking to this person you are working for I can't gauge why they feel the need to financially hold you responsible for an OOS. Because I don't know your status (employee or contractor) I can't say much more. Working as a contractor can be a great way to work. I know people that are doing this and are making net OVER $150,000 a year. However for ever good situation there are maybe 25 not so good. I personally don't recommend anybody do it.
To answer your question, well it depends! Are you an employee? Are you covered by a union CBA? Does your state have language in their employment law that covers it? Nobody here is going to be able to give you solid legal advice, I suggest if you want to continue doing this and are concerned go ask an attorney well versed on your state's employment laws!Just passing by and ksray Thank this. -
$1000 good motivation for company driver to do real pre trip inspection. Not just false record in logbook.
