This is my question, if the broker offered the cancellation in writing, then taking it would have been a trigger to send the invoice for the tonu.
if not, then his threats I would have told him where he can stick that.

After ANY verbal communication which has financial, contractual, regulatory or any other legal implications, I ALWAYS send a follow up email. I basically just repeat what was discussed in point form. This accomplishes a few things; it clarifies what was discussed and if the other party doesn't correct or dispute any of it then it is their tacit approval, it also provides a written date and time stamped record of any communications. I do it for both internal and external communications. Also, just making notes of what was said and when can go a lot farther legally (if need be) than just stating what was said.

I had this almost happen to me several weeks ago. Girl sent me a rate confirmation sheet with no pick-up number on it. I told her she had one hour to get it to me or else I was going to continue looking for something else. Which is exactly what I did, I found something else.

Of course there is. I added my TONU/cancellation and detention policies to the Agreement as well as the rate con with both parties signed on each document.

Not sure what you mean by "official capacity" responses. Yes, he ordered the truck for Monday and hours later decided he needed to move it to Wednesday. At that point the truck was not available as I'd built a route off his run that delivered in Ohio. He's playing on words claiming he didn't "cancel" it but rather "postponed" it.06driver Thanks this.

I meant when he was going to "report" you to whatever board. Didn't know if you can dispute it.
Original sheet was assigned for Monday. Truck not used Monday. QED TONU.

Gotcha. Well, he can report lies all he wants. I don't know much about Freight Guard but I guess now's the time to get acquainted. I find the fact that he's threatening to slander my reputation to be particularly offensive.

The better boards give you an area to respond to his review of you, and you can also leave a review for him which he can respond to. Slander is a two way street, even though your version isn't slander. I'm guessing it's a baseless threat that he won't follow through with, and he'll do everything possible not to pay you a dime.DSK333 Thanks this.
