Look this is a serious serious problem, the owner is a pos who will dump on you in a second, if you have an accident, or an incident, he will screw you over in a New York minute.

And I can not stress this enough, if you care about your family and your means to make money

FIND ANOTHER JOB.

I can see why too. Listen, if you are responsible for your taxes you are NOT an employee under most circumstances. I know this because employers are required to fill out an IRS form 941 every 3 months on ALL employees. If you are getting a 1099 at the end of the year you are not on that form 941. Only you know your full situation. I still advise walking away. However in the end this is your decision. Oh and to answer your first question, YES he can collect an escrow.
