    In this day and age, with cameras on every school bus and most
    cop cars. I wonder if a truck driver will lose his driveing priviliges
    for doing the same thing. We apreciate your honesty Turbo I
    wonder about drivers that say they would wait for the train for hours
    then call their dispacher to come get them. A few years ago I got
    a ticket for getting in the restricted left lane of I-95 at 2am to
    get around some very slow moving trucks that had the 2 right
    lanes blocked. I slowed down or endangered no one by being
    in that lane but I broke the law and for several years that was
    the only moving violation on my record. There are cops out there
    that will bust you for trying to use common sence. I am glad
    that PossumBelly and PackRat were not caught by the one
    that got me.

    if this railroad track(s) were on the Phelps Dodge plant property, then maybe i could see your situation. i would often go to a plant in Wallingford, Ct, named AC Moldings. they supplied plastic pellets, and they also made hot tubs/spas. they had several rail lines with-in the complex with warning gates or signals. the speed of any train with-in that faclity would amount to "idle speed", or "walking speed".

    i never had to cross any of the tracks when the signals were turned on, but now in your particular situation (packrat), i could "see" that you can cross those rails, but only if you were on company property, perhaps as Phelps Dodge might have been.

    still in all, anyone takes an incredible chance crossing railroad tracks, signals blaring, arms down (or not), as we all know all too well that sometimes those warning devices malfunction and do not warn us of oncoming trains.........

    The tracks crossed US180 near the Phelps Dodge Smelter at Hurley, NM. The tracks connect all the mine facilities to the smelter facility and the UP mainline south in Deming. The rest of the crossings are located within the "company town" of Hurley. It wasn't worth building a bridge over the track since it probably gets crossed at the most every other day. The US180 crossing is the only location that's wide enough for a truck to go around the crossing guards since the road intersects the track at an angle. Its at the "sight" angle so you get a clear view in both directions. Since the track and signals are maintained by Phelps Dodge I'm not suprised they fail often judging by the abysmal condition of the Phelps Dodge sites in the area.

    Again, I believe no reasonable LEO would have written me a ticket under the circumstances.

    kc0rey...thanks for taking the hit on that for me, too. I was wondering the same thing. I am not very fond of cops and their kin, and there is the guy from college that I REALLY hate, and so I thought LEO (his name is Leo) was referring to him. LOL

    Actually it has happened. George Ryan fromer Governor of Illinois was recently convicted for a whole bunch of stuff including selling CDLs. I think he got 6 yeats in the Federal Pen. He does get to keep his pension though.

    A CDL school in Missouri recently was indicted for selling CDLs.
