    Going to the sleeper while you are waiting for "anything work related" is always your best option. Or if the company you work for allows meal breaks and you can go eat while they load/dispatch etc then sure log off duty. Normally when loading/unloading two logic statuses would be sleeper or on-duty

    Now the question you have to ask yourself!

    Is it worth taking the risk of running "illegal" to make a good pay check one week and no paychecks for the next week or years ahead?

    If you get into an accident (at no fault of yours) that accident could be held against you in the court of law. Therefore someone gets killed then you could end up serving jail time for vehicular manslaughter.

    I have to point that out because well that's just me! l.o.l.

    I know the economy/freight and all is way crazy and many drivers are suffering and I so feel for you all! I really really do! But I don't want to hear from you while your behind bars either. Well yeah do let me know if it ever happens to you because yeah I just want the story for my book :) but lets hope it doesn't and you get a good check!

    Well my book looks good and I do everything that I log, just not at the exact time I log it. If I get in a wreck I am screwed but right now not sure what else to do. My average length of haul right now is about 200 miles and I only make .30 per mile. My company says they pay detention and layover but I have yet to see any. Take for instance my load thurs. I picked up a load that went 185 paid miles. Took 4hrs to get loaded drove 30 min. to the first scale and was over weight drove 30 min back to the shipper waited another 3 hrs to get the load reloaded. drove 30 min back to the scale spent another 30 min. getting my axles right and finnally on the road. Hit rush hour traffic so it took me roughly 4 hrs to make my 185 mile drive. Then I was late for the delivery so I had to wait another 3 hrs or something like that. Now if I had logged all that just like I did it I would already be over my 14 and be getting paid $55.50 to do it and would have had to refuse my next dispatch. I wish I could say that was a rare occasion for me but its the norm. I am looking for another job but its slim pickins' for me with only 3 months experience. Sucks because I am a great driver and this was my first late delivery which wasn't even my fault.

    This will keep happening as long as dispatch knows you will falsify your logs. I don't know if you have Qualcomm or some other tracking system in your truck but if you do FMCSA will check the record of your locations against your log book if they audit the carrier . Read part 395.8 (k) . http://www.fmcsa.dot.gov/rules-regu...r/fmcsrruletext.asp?chunkkey=0901633480023971 Your scale tickets are supporting documents as are fuel tickets and phone records . These could also be checked . Being in violation of HOS is criminal negligence and could land you in jail in the event of an accident as well as result in a civil suit being filed against you as a driver . You're putting your whole future at risk .

    So what would you do in my situation? If I log 100% as i do it I will never get a load. I guess I can always go back to Taco Bell. #### government has to get there hands in everything?

    I won't deny I haven't been there and done that years ago . I also believed everybody did it . Then I found there are companies that do insist you run legal . I swore I'd never run for a company that used Qualcomm . But guess what ? I actually make more running legal and working less hours . The better paying companies have better customers that pay better rates . They understand safety is a part of reliable service and schedules are reasonable . Customers concerned about lower rates don't expect much for service .
    Just remember . Every driver in your company running illegally is putting you at risk . If any one of them gets in a serious accident FMCSA will come in and audit all the logs . Falsifying logs is a felony .

    I agree with RickG. That is exactly what I would tell you. I work for a company that will not tolerate illegal logs and dose pay Det time and layovers. If I can't do it legal I don't do it.

    Every driver in your company running illegally is putting you at risk .

    I want to say to this statement is every driver running illegal is still your freight you could have when you are legal.
    If a driver is taking freight illegally he is taking from the driver that wants to do the right thing. I believe (not positive) if all drivers would run legal they would see the freight spread out more evenly.


    YOu made very valid points as well I just wanted to add a theroy they might realize and do the right thing.

    I thought my carrier was already very strict but they recently sent out notice addressing this . Drivers not showing all their on duty hours so they could get loads that should go to drivers that had available hours will face termination . We recently replaced Qualcomms with Blackberries . The GPS in the Blackberry is pinged every 10 minutes .

    Unfortunately the world is getting worse (economy) so it's fight for survival while you can. Unfortunately it's going to back fire on at least 1 person (unfortunately) hopefully not.

    Good luck in fudging the books, I definately don't advise it. Do I understand you drivers need to feed the family YES! What else can I do hang out with you and nag you every day. NOT! That's not me. l.o.l.
