It doesn’t necessarily need to be the same town. I’d try to find the best rated lawyer,closest to where he lives. If he googles the name and finds they have a good reputation it may put a fire under his butt.

You don’t have to go to his state. You can file in your state, and he can electronically appear for court through the phone. Just make sure he is served properly. Try to get a sherif to serve him.
If there is a issue with jurisdiction he still HAS to challenge the jurisdiction in the court where you filed, which is your state. Make sure you file in your state for these purposes

Whenever you decide to become the competitor to who your working for dont tell anyone. You should have went on a extended vacation , collected your money and than let them no your finding different work . I wouldn't even tell them your getting your own Authority. Hind sight is 20/20 , I was in your shoes in a different business and made the same mistake thinking I was being a decent person . Good luck

I apologize, I will add to this.
When going to court you have to have control, which means you need to be a step ahead and understand how laws and court routes work.
You want this in your state and you want to claim a lot of things.
Ask for motion to audit his accounts to make sure he didn’t skim your rates. This means you will involve his factoring, credit line, bank, or whatever he uses. This isn’t good for him.
Motion to pay your lawyer fees, time lost, etc.
If he disregards these things courts will give you what you ask for. This is why you need it in YOUR state. It will cost him more to battle in your state than give you your money, and even more for your time.
A letter from a lawyer is just a threat basically, that many disregard. Being served by the sherif is a different story. -
So outside of the issue of what you are owed, everything else is not important.
However you have to have proof of what you did, not what you were offered. Which means logs and signed bols with your signature attached to them. Rate confirmation may not cut it with a judge.x1Heavy and KingRaheem Thank this.
