log says sleeper, but...

    Yeah but you can't log behind the wheel as off duty . Is it done ? Yes , often but you're taking a chance . Accident attorneys depose unbelievable amounts of info for discovery . Don't even think about calling dispatch , using the Qualcomm or even buying oil when logged off duty .

    Cant without going to line 4. Remember the "any time youre out of the sleeper" garbage?
    Well, I use common sense and my log LOOKS legal. The machine can choke on their rules and regulations. I know whats best for me!

    That's also on duty . Any time in the truck not in the sleeper is on duty .

    Hey , I know the regulations are screwed up . They say you can be off duty at a terminal if relieved from responsibility but that exemption isn't stated when in or on a truck .

    I thought if you pull your cab curtains around, the entire interior of the truck is now sleeper berth since you can't see out. Obviously you can't be on duty because the windows, windshield and mirrors are all out of sight where the driver cannot possibly operate the vehicle. Sit wherever you like and it goes on line 2 in this scenario.

    More than anything, this topic illustrates the "between a rock and a hard place" position that drivers are often placed in. Would any "reasonable" person cite you for sitting in the driver's seat if you were clearly off-duty, doing something like surfing the 'net? No. Unfortunately, lawyers are the furthest thing from reasonable when they are looking for money, and there's enough richard craniums posing as LEOs too.

    i read on a HOS FAQ somewhere that short conversations or something may be had with company without going on-duty

    That's true . I wasn't talking about FMCSA . I was talking about attorneys in a court case . Juries don't know squat about HOS .
