My wife is an atty for the state supreme court, the emotions and heart strings that get pulled on at a jury level don't come into play. They go based on case law and procedure. A person who is drunk and hits someone won't see that money once it gets appealed, I promise you.
It goes before a panel of 10 judges and gets ruled on and sent back to the lower courts. Insurance companies will fight that verdict til the cows come home and its reversed.Dave_in_AZ, bryan21384 and MACK E-6 Thank this. -

Problem is.....what driver can afford the lawyer? That’s why most of these guys that break HOS rules and kill someone do time.....they plead guilty. That one guy.....seltzer......was only 3hrs over but he plead guilty yet the Walmart guy walked. I’m guessing Walmart paid the lawyershogun Thanks this.

We get it, You run way illegal and then create a log that shows you ran legal.
Your logs may pass a road side inspection but if a lawyer that is suing you goes through your log book and cell phone records, you're done,
Why not just drive when you have hours and park when you don't have hours?
Millions of us have found a way to legally drive a truck and earn a good living.

Actually the Walmart driver had about 30 minutes left on his 14 and was going to park at a nearby store for his break, but the being awake for that long wasn't very smart
