    It's a legitimate question deserving of a valid answer instead of the BS he got. There is a legal requirement as to what to do in such a situation whether you agree with it or not. Even if you choose to disregard what you are legally required to do you best know what those requirements are if for no other reason than to avoid getting caught.

    If your company falsifies your logs you are required to refuse to certify that log. You are also required to certify your logs every day. I would have to look up exactly when but there quickly comes a point where you cannot legally drive until they correct the log so you can certify it. If you certify a log you know to be false then you are guilty of falsifying your logs. While your chance of getting caught violating HOS is much greater than falsifying the punishment is far more severe for falsification as my logs department is fond of pointing out. Legally you're required to refuse to falsify the logs and then refuse to drive until they are corrected so you can certify them.

    You have specific protections from a company retaliating against you for refusing to violate relevant rules, regulations and laws concerning the operation of a commercial vehicle as well as operating the vehicle in an unsafe manner. Many might laugh at that since they didn't bother documenting jack. There's a whole lot you don't know about running a trucking company and they generate a whole lot of documentation. Your vague recollection of events months ago doesn't count for much versus all that documentation and all the things you knew nothing about.

    The biggest single obstacle to documentation is you cannot record verbal communications without the consent of all parties recorded. That isn't just phone calls, that's face to face as well. What you can do is keep a log of your calls. That isn't just time and date, but also a summary of the conversation. You can then use a method you can use in court, such as an e-mail, to recap the conversation and ask if that is an accurate summary of the conversation. That leaves them in a bind. They can ignore it, agree or offer a correction. If they have any sense they'll correct it if it shows they said something they shouldn't. If they do the correction is all that matters.

    The most likely retaliation is load assignments, you get all the crap loads from here until you quit. You should keep a journal. Every time that truck stops you record odometer, date, time and description. Every time you perform a work related activity that doesn't involve driving you record the date, time, duration and description. Request your logs every week. An legal e-log has to allow you to e-mail your logs to a LEO upon request and as such you can e-mail them to yourself. Keep copies of all paperwork.

    If they really jack around with you then put the screws to them. Every company out there is doing quite a bit illegal. If you have documentation trying to retaliate against you can cost them all the profit off several trucks for year. It just isn't worth it but they may have to find that out of themselves and with a small firm it might well put them out of business. Any company with any sense will back off when they find they can't bluff there way through. Generally all it takes is a shot across the bow. Just one message saying this is my understanding of our conversation, please confirm or correct is a shot across the bow. The only reason for a such a message is to lay the foundations for a lawsuit.

    Those saying don't be a snitch might as well be telling you if someone hits don't hit them make, just beg for mercy. No, sorry, if I go down it's going to be despite using every means at my disposal, particularly the legal ones. No, sorry, the craven little coward is the one afraid to fight back.

    I am about to tell you how to report a driver or company that violates the regulations. FMCSA has district offices. Get on the Internet and find the district office in which this company is located. You sit down, write a letter, giving dates, names, truck numbers and any additional information that provides evidence of your allegations. You must sign the letter or it will be find the way to the trash can. Your identity will be protected unless it ends up in a court room. When the FMCSA walks into a trucking company to do an audit or investigation they want to know before hand what they are looking for. They dont go in blind.

    it would have been more substantial had he been (still) working there, rather than from my point of view, perhaps ticked off he was not even hired?
