That was a good response , Im6under . I appreciate it . About that having them come out when the light didn't change ..Get this . We have a terminal in Calvert City, KY and I sometimes bobtail to Owensboro . Three times the KY scales have been open on I-24 and I'll bobtail in behind loaded trucks . They'd get the bypass and I'd get the arrow for the scale . Each time they'd just look at we through the window and wave me on .. Can't figure it . After the first time I was careful to watch my speed and distance behind the truck in front of me . Still have to bobtail over the scale .
log says sleeper, but...

I show off duty anytime Im not sure how long Im going to be in the sleeper. This protects you from over zealous enforcement. You can always change it to sleeper later if you need to, you are allowed to correct log book entrys, and initialing the correction. Also stay Out of the Drivers seat if your not going to move the vehicle. If your truck has the motor running and your sitting in the drivers seat your drivng (because your are at the controls of a running vehicle) theres is not argument for that.
The other day I stopped on a side street and caught a cat-nap sitting in the drivers seat, motor off, and I was still logged as driving. The Zealot that knocked on my door said I was in voilation, So I called for a supervisor. The Sargent showed up, said because I was still logged as driving, I was fine and instructed Barney Fife to go back and do something useful. You always have to be careful.
Also remeber when you see a officer doing something you do not believe they should be doing, or if they are rude call the Watch Commander, they are alway glad to assist you and it does go on there record, simular to the citation they put on yours. Logging complaint against law enforcement is part of the system.im6under Thanks this. -
The difference is about 320.00 dollars here in CA. Log it as off duty.

I'm going on the 21st hour of my 34 hour reset at the truckstop. I couldn't hold it anymore so I had to pee on my mattress. Whew... it's soaked now!
And dang, wouldn't you know I forgot to get any food before I went to line 2... I've been picking foam out of the seat and eating it to calm my rumbling belly. Soon as my 34 is up, I'm heading straight inside to get a bag of Cheetos and play some video poker.punkinhed Thanks this. -

30 minutes seems a little lenghty to talk to a dispatcher, but you dont need to interupt your off duty status for communicating to dispatch regarding this.
This would take less than 20 or 30 seconds at our company normally. -
better stock up on food, or next time you'll have to eat that mattres. (I left the last s off for "savings")

Off duty and restarts can be any combination of sleeper berth/off duty . The regulations have been posted in at least half a dozen threads

Could be the way you hit the plates on the ramp. Maybe you aren't getting all wheels to cross them. Had that happen to me once or twice at a scale in TN. I pulled around back and went in (the scale master that day was a neighbor of mine) and asked why are you weighing me when I was bobtailing? First time he was laughing himself silly when I walked in. He knew I'd just left the house and was on the way to pick up my trailer in Greeneville SC. Saw me coming down the ramp and figured he'd pull my chain. Second time, he said (honest truth from him) is that I probably hit the plates wrong and didn't get all wheels weighed.RickG said: ↑... Can't figure it . Dave27107 said: ↑O.K. how am I interpreting this wrong ?RickG said: ↑As I sit here typing this, I am waiting for dispatch to find me a load. Based on what you have said, I should be logging this on duty, not driving. No it is not part of my 10 hour break. Referring to what I said, I have nothing from my carrier to indicate I am allowed to log any time as off duty. Oh, and we don't have a "driver's manual" or anything that comes close to one.
Therefore, I stand by my earlier comment, based on what you say, I can only log line 3 (driving) or line 4 (on duty, not driving). To be in the sleeper berth constitutes being relieved of duty. Since I have nothing in writing from my carrier, I can't even log sleeper berth (line 2).
I decided to check on the requirement for written authorization to be relieved of duty. Here is what I found on the FMCSA website, under rules/regulations/interpretations for 395.2:
Question 2: What conditions must be met for a CMV driver to record meal and other routine stops made during a tour of duty as off-duty time?
Guidance:1. The driver must have been relieved of all duty and responsibility for the care and custody of the vehicle, its accessories, and any cargo or passengers it may be carrying.
2. The duration of the drivers relief from duty must be a finite period of time which is of sufficient duration to ensure that the accumulated fatigue resulting from operating a CMV will be significantly reduced.
3. If the driver has been relieved from duty, as noted in (1) above, the duration of the relief from duty must have been made known to the driver prior to the drivers departure in written instructions from the employer. There are no record retention requirements for these instructions on board a vehicle or at a motor carriers principal place of business.
4. During the stop, and for the duration of the stop, the driver must be at liberty to pursue activities of his/her own choosing and to leave the premises where the vehicle is situated.
Based on the above info from DOT, there is no requirement for written authorization of relief from duty. So I can decide when to be off duty, either eating, showering, watching TV from the driver's seat or laying in the bunk reading a book, etc.Click to expand...
