Real Deal on SWIFT/ DOT POLICY

    :biggrin_25510:I just recieved my DAC report after requesting it from USIS, so the write up i got goes as follows;

    reason for leaving Discharge (or company terminated lease)
    status co driver
    equp used Dry van
    loads hauled gen comm work record;company policy violation

    thats the first page, then on the second page reads as follows
    The following information on this driver has been provided by the motor carrier listed above. This information satisfies your driver background checks for this company under 49 C.F.R. part 391 for the period of service noted below. Information older than three years will not be included on this report.

    DOT/alchol violation;Yes
    test refusal

    Driver refused a controlled substance or alchol test.

    I did not refuse test, I went at the time the DM and I both agreed on, When I arrived they refused to even let me take the test saying I was 'Red Flagged". the DM lied about the agreement and refused to man up about his miscommunication about what took place on the phone. What i'm asking is the last part. IMFORMATION OLDER THAN 3 YEARS WILL NOT BE INCLUDED ON THIS REPORT........this april will be three years, does that mean I'll be able to reapply for OTR again, or if at least local work ???     If I read correctly the refusal was in 4/2007 and this April will only be 2 years

    ok wrong calculation, but does that mean that i'll be able to reapply for OTR again??? In my time i have never refused or tested positive for anything. well thats because I dont do anything period. SWift has messed up alot of peoples lives for their lies to DAC and to other companies.

    You need to contact the people that refused to test you and get a written explanation of that . Then notify DAC and dispute Swift's statement .

    i got my DAC coming to me cuz i got discharged by Swift for an accidnet minor one but just curious how they stated what the accidnet was on my DAC cuz i cant find work anywhere cuz of it and well its starting to really suck the life out of me

    Unfortunately for you. You and your DM discussed this prior to reporting for the test. A big no-no.

    But based on the rumblings I am hearing, it will not drop off your DAC in 3 years. They're wanting to place and keep failed/refused on record indefinitely.

    Grab DacFix and see if you can get something done about it now. Next year may be too late.

    yeah I've been a pro nearly 10 yrs now never a #### problem until SWIFT, now im fighting for my livelyhood and to get bills paid , i guess my next action is to state senate or even to Obama's office himself

    Well I wish you luck on that. Don't think they will give a crap. Fact is your DM should have never said a thing to you. If he mans up and says something now he will lose his job. And he isn't going to do that for any driver.

    I would like to know how long a company like SWIFT holds there records for reguarding DOT randoms ?? My situation has been almost two years now.... going to fight it non the less dispute what DAC has in there system as its one sided, noone ever contacted me on my version of what happened , to me thats a failure of a right to DUE PROCESS... later
