Heh my first job was a dishwasher. I wanted sundays off and they kept scheduling me for Sunday and denying me.
So I quit.
That is simply appalling. How can you teach your kids the value of a dollar with crap like that going on? -
Well they ran afoul of the federal civil rights act. And she fully disclosed why she couldn’t work those days due to religious beliefs (which is covered under the act).
And the fact that they kept scheduling her for those days on purpose until they terminated her shows premeditated retaliation on the hotel’s part. That landed the hotel in hot water-and I don’t mean dishwater either.Tb0n3, Swiss Mountain Dog and Sirscrapntruckalot Thank this. -
I agree whole heartedly, the employer is a scum bag. However, the valuation of 21 million dollars in damages is totally asinine. Just another person (and a bunch of lawyers) looking for a payday. Imo, the damages she deserves should be the income she didn't earn while the lawsuit was going on, a few months worth of household expenses while searching for a new job, legal fees, and call er a day. Not an amount that can set several people up for LIFE.
I know that doesn't set an example to companies screwing around employees, but the majority of people wont earn 21 million in all their days. She won the lotto here!JonJon78 Thanks this. -

That’s why they’re called PUNITIVE DAMAGES-to PUNISH the defendant(s),to make an example out of the company and make them think twice before pulling a stunt like this again! And it puts other employers on notice!
When you violate a federal law (especially a workplace law) they’re not going to give you a simple slap on the wrist! The hotel got off lucky-just imagine if they ran afoul of a occupation that involved OSHA!Last edited: Jan 17, 2019

How can you teach your kids to stand up for their beliefs if you constantly knuckle under?
Damages in Flordia are capped, total payout to the dishwasher is going to ve less than $500k. Still a lot of money, but imo entirely justified because the company honored her request/requirement for 6 years then decided to blatantly disregard them - probably because they were short staffed and didn't want to offer a high enough wage to entice workers to hire on/stay on. Sometimes these large corporations need a wake up call. The lawyer stated that he asked for $50 million ecen though he knew things were capped to send a message to corporate.Sirscrapntruckalot Thanks this. -
Discrimination is when you treat someone differently than everyone else. I disagree with the notion that she was discriminated against. If everyone is required to work Sundays, then she was not discriminated against. She was held to the same standard as everyone else.
If it was clear that everyone was expected to be able to work on Sundays, and her religious beliefs didn't allow for that, then that was a job that was not for her.drvrtech77, Coover, JonJon78 and 1 other person Thank this.
