Being Charged for Idle?? Pay deductions??

    Does anyone know if this is legal, would a labor board attorney find this illegal? At the end of the week does a painting contractor charge his employees for using extra paint or how about a carpenter for extra wood?

    The last I knew it was illegal to make a payroll reduction without and employees consent. If this is still true i would think a large class action suit is in the makings.:biggrin_25525:

    Payroll deductions require a signature, even with Federal and State taxes, you sign for the employer to deduct. I believe that the only deductions that do not require a signature from the employee are child support and garnishments. It is illegal for an employer to deduct anything else from your paycheck.

    I hope they can't, I'm always over my 30% idle time. I'm comfortable in here, just like they are.

    would have to see the app you filled out but that is what alot of companies are going to myself id run from a company doing that if they want there idle low they should get apu's

    Not so in IL. I don't care what you signed, you cannot deduct anything but taxes, insurance, and any court ordered deductions, period. I would absoutely call the labor relations board the first time anybody deducted idle time from my check. They will get your money back and it won't cost you a dime. (At least in IL)

    May not cost a dime but guarantee the company will find a reason to terminate him and give him a negative DAC .
    I worked for a company once that had quite a few trucks getting damaged . They started charging drivers the $500 insurance deductible and withholding it from their pay . It was really BS because the company had their own body shop and never put insurance claims in .

    You need to call an attorney in your area that specializes in labor laws. Why would you ask a legal question such as this to drivers? It's kinda like calling a plumber when you need a lawyer. Instead of listenening to 500 opinions that do not mean squat, you should talk to an attorney that deals with this. Like some posted take all of your paperwork with you when you have your attorney consultation. Other than that our opinions are not going to matter.

    I have contacted the labor department concerning the payroll deduction that was made by an Illinois trucking company. They stated they do not deal with the truckers, it is not covered by them.

    As far as the signature, it is in a form you sign that they give you for the electronic deposit of your check. It states that a payroll deduction is allowed or authorized if an error has been made in the deposit or any other payroll related transactions.
