I got a ticket the other day in Klamath falls Oregon for 6,000 lb overweight on my tandems and 1800 pounds overweight overall.
Never had an overweight ticket before I usually follow the law. this load was pawned off on me as a medical emergency the driver parked his truck on the side of the road and was taken to the hospital for a heart attack or COPD not really sure just know they sent me to retrieve the trailer before the reefer ran out of fuel. it was on 97 in Oregon there was no place that I could find to weigh the load I just simply hooked up to it got the paperwork out of his truck and took off only to wind up with a big ### ticket $933. To make it worse I was pulling the load for Fairchild freight for an owner operator who come to find out, was in bankruptcy court so needless to say I didn't even get paid for the run cost me another $400 to fly out of LAX after I park the truck in Ventura California after delivering to Ontario California Target distribution. The DOT officer said if I wrote the judge and since I had no prior violations on my record they would probably let me out of it what do you guys think I don't even have a clue where to begin on trying to fight this as I live in Fairbanks Alaska and can't show up to the courthouse in Klamath falls Oregon?
Any sensible help would be greatly appreciated thanks much.

What do you want from us, you cut your own throat. 6g's over on the drives, I imagine, is a whopper. Sorry, you had it coming. Air pressure gauge on the drives would tell you the whole story, and again, I'm sorry, but not being able to weigh a load is not an excuse to just go for it. I think you learned a valuable trucking lesson, and it probably won't happen again.

Call the court that's listed on the ticket. Explain to them what happened. Tell them you'll be more than glad to send them a written explanation.
Explain to them that you live in Alaska and can't appear in person.
I doubt if the court will totally drop the ticket but they might reduce the charge enough that you can afford to pay it.fss99701 Thanks this. -
Yeah, lesson well learned, don't ever pull on a scale without knowing what it weighs. I try not to pull on a scale even if I know what it weighs, you never know when Mr DOT is gonna ambush, those bad word.

There was an old saying, when you're legal, the coops are always closed,,,for some reason, and visa versa, like they have scales in the road ( cue X files music)Tombstone69 and fss99701 Thank this.

So you picked up the trailer north of Klamath Falls?
-
A few years ago I got a speeding ticket in my personal vehicle near Klamath Falls. Some guy with a trailer was in front of me on the highway, and was doing about 20 under the posted speed limit. Every time I had a clear lane to pass him, he sped up, so the guy was being a dick. I finally had a long clear lane and floored it, reaching about 80 as I got around him. A Oregon state patrol just happen to be coming the other direction and I knew I was screwed, so I just pulled over and waited for him. I explained what happened, and he told me to write a letter to the judge in that county because I lived in California. I did, and the ticket was dismissed. So it's worth calling the county court and finding out where to send the letter. It may get you out of this mess.

The suspension gauge PSI reading would have been way over a certain amount at 6K over on the drives. Not to mention a tractor unwilling to get up and go with the engine falling down and rough ride that heavy too.
Im also sorry mr driver got sick with boo boo and ows. Hope the hospital can fix it. But Im sorry there is no CAT scale ticket from the local shipper's area on load pick up. No wonder you have scale issues and tickets. A 10 dollar weigh at a CAT would reveal a problem that needs reworking at shipper before you go too far away. Or even loading onto two trucks.
Im sorry that the OP got stick with the ticket, I would contact the Oregon Court and tell them that you are the one with the short stick and not the original offender who failed to recognize a problem in weights long before they got there.
I hope I am not sorry I posted here. /sarcasm. -
If you are working for the same company as the driver who originally picked up the load bring this up with them, The driver having a emergency right before the scales and giving it to some other driver is a bad set up. you got screwed.
