    If the driver is successful in defense at court pertaining to hours, it might be a first.

    Well, sad for those who died but this is what happens when government over-reaches and acts like they are God. “Unintended consequences” are real and need to be reckoned with.

    Looks like the suv driver was out of hours. Who’s really to blame here anyway. Who left the roadway becuase they were texting or asleep behind the wheel

    It is truly a shame that innocent people are killed.
    Both at fault here it appears.
    We need more flexible HOS rules and relaxed semi parking regs for surface streets imho.
    In court both will shoulder blame but imho the truck being on the shoulder versus a car out of the lane of travel exceeding the speed limit gives most of bame on the auto driver.
    I've worked in Emeryville and driven the eastbay and it's a very congested high speed area.

    That truck is way off on the shoulder. The suv driver had to have dozed off. Only innocent is the passenger. Suppose the driver hit a bridge structure further down the road. These sleepy four wheel drivers kill tow truck drivers everyday and night like this

    From the looks of the picture he was a good 4 feet from the nearest Lane. Bad situation I wouldn't have park there myself but if I had to I would have set out some reflectors to help out the people on their cell phone sending tweets. After all it was California.

    How about the driver actually trip plan and stop blaming this on HOS instead of his lack of ability to do his job?

    There is more to the job than holding the steering wheel....

    “Way off on the shoulder”? What do you base that on? Looks like not only was he on the shoulder, was also right up against an immediate guard rail. Was ticketed for illegal parking and was probably deserving of that ticket and also deserving of any future guilt and legal consequences. I have no ability to forgive anyone parked on the shoulder unless that have mechanical failure forcing them into that position.
