Brokerage Setup Question

    It's been a while for me but .... Legally DOT states that it is law that they be separate. That's legally. If your a small company like we were it's going to be all the time you have load tenders on your desk for your carrier and right next to them you will have load manifests for your brokerage. In our case the way it worked was I was in 1 office running the carrier and a family member was in the office across the hall running the brokerage.
    As far as the back soliciting goes most brokerages have that clause in there contracts , I've never heard of it being used though I'm sure it must not be out of the realm of possibility. I always thought it would be cool to test out. I always had business cards and when I would pick and drop the loads personally I would give them my business card. If ... And it never happened ... But if I ever got a call from a broker saying hey you back solicited !!!! I would say they asked me for my phone number so I gave it to them. Besides what does back soliciting actually look like ? I've never seen an actual description of what exactly that would look like.

    I always thought they had to be separate due to separate mc#s. Good thread,Info etc. Makes sense though to separate them if Brokerage profits are at risk of potential Carrier Liability. Lawyers always look to see how deep your pockets are.800 k gross sounds nice, good job!!

    Since MAP-21 any new brokerage must be separate numbers. If they were under the same number before you don't have to change it.
