Has anyone had a bad experience at the Lordsburg, NM weigh station? They pulled me in and said my windows had to much glazing and then told me they were going to do a CAB check. I told them they could not search my truck but they did it anyway. Checked the CAB and the sleeper.

As long as they have the badge and the gun - they do what they want.ALways been my experience that they do what they want regardless of the law.

They had the right and duty to inspect your vehicle, inclusive of the cab & sleeper pursuant to the FMCSA rules. It basically amounts to implied consent. When you drive you are required to conform to the applicable rules. If the state cops believed you had too much tint/glazing based on the rules then the state police had reasonable suspicion to inspect further. The same thing can happen in your auto. If you had an inoperative turn signal & were pulled over for it, then the cop checks your license, registration, proof of insurance because he has that right. And if he smells marijuana during that stiop he has the right, as well as the duty to inspect the vehicle.
You must also remember that driving, even driving a commercial vehicle is a privilege, not a right. No state is absolutely mandated to issue you a driving license.
