Is it legal to weld this or not?

Grind it and weld with good penetration.

Get a grinder wheel, and get all that off as much as you can.
Thank you for the larger image, now I can see well. I say after you grind it good and clean, reweld as well as you are able. This will hold temporarily until time to scrap. That has been beaten too much and it's time to turn it in for scrap. You can find a trailer that is bad post wreck but should have a good carriage frame under it. Or replace the trailer outright. -
