No it is legal to weld, it was welded when new anyway.
It is a replacable part anyway if you want to weld a new one in there, they are not that spendy, but more labor cutting the old one up and cleaning it up for the new one.
Is it legal to weld this or not?

I would replace and weld myself. I know it will be welded properly just wanted to make sure DOT wouldn’t have a issue

No problem I have welded them right at the scales, when the DOT required it before they could leave.
