Weeeeelll...unless an owner wanted to risk leasing his/her truck to an independent operator. It would be no different than leasing a truck from Penske, Ryder, or Idealease, etc...the lessee doesn't actually work for any of them.
However, as someone remarked earlier, "if you hire a driver...", the irs will call you an employer. If you only lease your equipment to a driver to use, the IRS will not call you an employer. If leasing the equipment, as with those big truck lessors, restrictions on the use of the equipment doesn't mean you're exercising control over the driver...only the equipment...your investment. However, beyond that, any controls the lessor places on that driver, will likely lead the IRS to conclude the relationship is truly employer-employee.
I met an unfortunate driver for a shady outfit who were LEASING their trucks to drivers and calling them independent contractors. Then, the drivers would lease the truck they just leased from the owner, back to the owner's company. However, the drivers were dispatched by employees of the owner's company. They even had driver managers to "help" them. They could choose the routes made available to them; they couldn't freelance. They withheld this poor fella's pay after a breakdown cost "him" $20k in repairs.
My only advice to him was to organize with all the other "independent contractors", hire an attorney, and sue the company for fraud, WHILE getting the IRS to pay the owners a visit...sounds like the "chicago russians" I've read about here, although I believe he said they were croatian.Last edited: Apr 25, 2019

I drive for a Landstar BCO that pays on a (W2 and with full benefits) that has fleet of 1-3 year old trucks and some new 2019 trailers. A lot of the comments from people on here are not true or they don't know what they are talking about!
