FMCSA looking into detention

    It should be recognized that frivolousness of detention by shippers/receivers is unacceptable since the ELD mandate. At the time of paper logs, this could have been tolerated to an extent. People falsified the logs, said "Mother####ers!" and moved on. Nowadays, unpaid detention is going to effect your livelihood and cannot go unaddressed.

    Add to that all those deceptive practices and brokers who try to find a reason not to pay it. "You did not call 1 hour prior", "The BOL did not have in and out times with a clerks printed name or a receiver/shipper official stamp". "You did not submit the request within 24 hours" .... this type of BS excuses not to pay. Also there are shippers/receivers who are a pain in a ### to ask to acknowledge a detention having taken place.

    Perhaps, there should be some preventive measures not to allow these practices any more. Those shippers/receivers/brokers would not want to be kept in one place for many hours uncompensated.

    Well, since it is a free market, then there could be a detention waiver available for those who don't mind. But I'd rather not to have this available as this could be abused too.

    For example "Dollar General" in Ardmore, OK have a trick of saying to you that you missing one or two POs and put you a stamp on the BOL that you sign, which is a detention waiver. The ultimatum is you either sign it or leave - this could be easily orchestrated in order not to have the detention paid at all. Or they will notice that you BOL has a handwritten PO and will ask you to leave to have a new BOL faxed then by the time you're back, you're considered late and forfeited any detention claims.

    Unless you are finding something I'm not that's not true yet.
    FMCSA has two programs going I'm finding about 18-20 year old drivers interstate.
    1. FMCSA Seeks Public Comment on Pilot Program to Allow Drivers Ages 18-20 to Operate Commercial Motor Vehicles in Interstate Commerce
    2. Under 21 Military CDL Pilot Program

    1. Is simply asking for comments. It will likely happen, this is just the first step. It's dated last month May 15, 2019
    2. Seems weird to me as there can be no way for one to qualify I think. It military personal that have been trained to operate a heavy vehicle. What seems weird is it's only for 18-20 year olds that are hired by a motor carrier in the program. How can a 20 year old be military, but be able to hold down a trucking job? Isn't the minimum enlistment 4 years at an age of 18?

    Look up the DRIVE-Safe Act. It's currently making its way through the House and Senate with bi-partisan support. Will very likely become law soon.

    So not green lit. Like I said I know of some programs to allow it, but nothing as of yet.
    And anyway the DRIVE-Safe Act already died once. Very, very few bills come back from that. (In other words I'll believe it will pass only after it's passed)

    if a new regulation happens it will only to be to enrich the regulators and as always it will be the drivers that will suffer, probably on the end in fines for every little thing that can go wrong.
