From the way I read the article, it was a boost to the drivers case, showed that swift was "stacking the deck" using the arbitration wording in the contract. No give and take that is required in contract wording to give the contract merit for both sides.
I will PM you on the next part of your post.

But capricious and arbitrary wording is what many contractual agreements contain. The meaning I took from it means that the Swift contractual agreement has no room for arbitration; it is a brick wall, regarding miles.
But I'd need to read the entire ruling before I could post otherwise. Where can I find this particular ruling to interpret it properly? -
I'd also like to see the Swift contract to see how it it is non-arbitrary and compare it to the ruling

Regarding pay accuracy which you also questioned, I've rarely had a problem and it's always been fixed when I call their attention to it. -
you sure that is 'per person'? Seeing how schooling is $3,900, and the average driver makes $30,000 his/her first year, etc. i highly doubt they will get awarded $5 mil per person.....maybe that figure is $5 mil settlement for the whole suit.

My mistake. The litigation was for at least 5-million, depending on #1. if the litigation receives class action cert, and 2. depending on how many drivers become a party to the complaint. I must have been relieving a brain far$ at the time and the gas bubble was enormous.

I am just shocked that this site had broad enough membership to find a Swift driver that can afford internet.
psanderson Thanks this. -
Dude, start another thread where you can copy and paste crap from the Internet. This has nothing to do with the questions I asked.
Thanks -
Thanks for the advise. But if you'll read some of the threads you'll see exactly what is transpiring on yours as well. Happens all the time. Get used to it. And I'm not called "dude".The word "Dude" relates to a greenhorn or a newbe as well as people who lost their automobile as in that stupid movie regarding someone requesting information about the location of a car

Thank you! Discussing this via PM would be great so maybe someone can answer the questions I asked.
Thanks!
