The wife and I have been driving for a few years and now we are wanting to pursue our hazmat endorsement..she has a clean record..I on the other hand...I have a felony conviction for distribution of controlled substance in 2005 and served 5 years in federal prison and finished probation in 2015....will this prevent me from obtaining a hazmat/doubles/tripples??...any info would be appreciated......thank you for taking the time drivers...and be safe out there

There’s a list of offenses that disqualify you...... don’t think that’s one of them.

I don't think you are disqualified. Those that hand out HM endorsements will decide.

    Visit FMCSA disqualification page.

Run a live scan on yourself and make sure the case has been closed and the DOJ has the deposition of your case meaning your case shows what took place and the actions decided by the court.

Then make sure you have all of your court documents as well as your prison records and release information.

In a perfect world you should have no problem. You just fingerprint and get your acceptance then head to dmv and take the tests and wallah!

However the doj does not always have all their information in order and if that’s the case with you then you’ll need to appeal the denial that will come from the hazmat application. That’s where your documents come into play. You’ll need to prove that you are eligible. Once you do this you will be golden.

Also. Should you get a denial or a hold on your application the letter you get will tell you exactly why they’re holding it. It will also come with the required appeal form that you need to fill out and send back with the appropriate documentation to prove your case.

At first I’d just make a photocopy of what you have and send that. If they deny those copies then it’s probably because they want the documents to be stamped by the courts which means you’ll have to go to the courthouse and have them stamp it.

While you’re there I’d just suggest that you have the court make copies of your papers or they make a copy from their own records. That way you still retain your copies Incase you need them in the future.

Again. This is all just worst case scenario. You might simply apply and have no issues.

Also thinking about it. I’d skip running a live scan on myself first because no mater what you’re still going to livescan at the hazmat office. So whatever is going to happen is going to happen. Save yourself the 40-50 bucks

If you get denied from the hazmat clear yourself with them. Then go livescan with the doj under a records accuracy check. Once you get the doj scan back contest the issues with the documentation you used to get your hazmat cleared so the doh can have accurate records and you do not run into this issue again when you renew your hazmat in the future.

Hopefully this helps and makes sense.

If you do not have your paperwork then you’ll have to go to the courthouse of the county your case took place in. If it was a while ago then they might not have your file in the clerks office which means they’ll have to request it from records and that can take a couple weeks.

I’d say run the hazmat app and see what happens. Again you might have no issue. If you do have an issue then you can start gathering paperwork
