Detention for accident

    I don't understand.

    Detention only applies to when you were on time and they (Customer or shipper) takes a excessive number of hours abusing your inability to do anything that day which will cost you money. That is what detention is for. You bill the Shipper or Reciever and they pay so much per hour or day to hold you and your tractor trailer out of the flow of commerce.

    Your Accident is your cost. God only knows when the parasites, lawyers, court etc quit eating into your wallet and or bank account. And then your insurance company will establish a higher premium on you.

    As a side note those fancy high fault'in titles such as independant contractor agreement is just high sounding BS speak designed to lull you into complatency and signing papers you have probably not read all the way through, and probably did not have a lawyer read all the way through and uncover the "Gotchas" buried in those cursed contracts under the boiler plate that you will pay up for this, that and other problems. Not the Carrier.

    I don't mind being a American Trucker, owning my tractor and trailer outright, with my own authority etc. Ive bought one bobtail in my life if my pen signed the name to the title and paperwork associated with that one particular bobtail with my name and their stack of expectations with it.

    I PREFER being a company driver. that way if there is any insomniacs pulling their hairs out late at night raging at the excessive costs of a accident it's their problem and yours as well. As much as possible YOU get to hold the bag.

    he damaged a "bit a car"....i wondering if it is the rub rail, and i'll just bet that was already pre-damaged.

    but in all reality, i love the accident descriptions from some, "little dent", "little scratch", "little dead person"......

    Almost all of the 1099 carriers I have been around or know anything about take a small percentage out of the linehaul to cover (THIER) accident costs, and only bill you the deductible OR take it out of your escrow account. Something sounds off here, just can't put my finger right on it.

    Well what do you expect, if the car was just standing there right in the way. I mean what is a guy going to do, when they just stand around.

    I don't understand how a company can pay you via 1099 if they own the truck and tell you where to go.

    In fact.. I know it's not legitimate far as the IRS is concerned. Maybe use that tidbit as leverage.

    The guys here lease you the truck, and the driver leases on to the carrier, it backfires on the owners once in a while when a driver just leaves with the check. lol

    Unless you are leasing the truck, any company that pays 1099.. Provides the truck without a lease.. Tells you when and where to go.. Is breaking the law..

    And will be subject to back taxes like matching FICA plus penalties. All it takes is a phone call to the IRS. They have a task force that works exclusively to penalize tax cheats who missclassify employees as independent contractors.

    Even if they are using the lease loophole.. Just look up a few megas who were sued recently and lost for exactly what I am talking about.
