Detention for accident

    I read a contract for a 1099 company and asked the lady interviewing "Hey, what is this truck rent stuff and why is there no number with it?" She straight tells me "Just ignore that, it doesnt mean anything. I don't charge you anything. My attorney said I have to rent you the truck or you arent really a 1099 employee. Don't worry. I don't really charge you anything" I told her I'm not signing that and left.

    I really didn't care though, I had nothing to hide. They asked me about my quad, i said I bought it at Valley motorsports in Kelowna, feel free to call qnd ask them...they didn't bother to call. I did have one trailer that wasn't insured, but it also was on blocks and had no tires, or brakes, as it was not be used. From start to finish they were at my yard for about 4 minutes.

    I have a theory why everyone is climbing over each other to get 1099. They are sick of the weak lispted company checks at 300 net or less. If they were to sign a form and turn that into 1500 for the week...

    yeah but then too, they have to set moiney aside each week for taxes, or set up quarterly payments, then if they get sick or need any sort of doctor, unless they have health insurance, it's all out of pocket.

    then too, if one gets a health issue that requires bed rest and high dollar meds, that is also out of pocket money, as well as no "sick pay" or "vacation time" that they can use for some weekly pay.

    i think the best thing to do is work a properly paying/taxing job, this way, it goes into your SS "account" so to speak (i know we do not have an actual SS account), so that when retirement comes along, one gets SS benefits, rather than an empty hand.

    There is a lot of bs about 1099'workers in this thread.

    1st thing that really is a misconception - if it is their truck, then it the 1099 is an employee.

    That's wrong. Other industries don't deal with this, you don't bring your tools to an computer project where you are there to do say some scripting?

    No you use their tools, not your own.

    2nd is this thing about how 1099 works, most owners and carriers don't do it right, they tell the person what to do. As a GENERAL rule, you give them an assignment and they can refuse to do it without any repercussions. If they accept the assignment then the carrier can't tell them how to do their job to transport the load. This includes routing, securing and logging.

    3rd, the contract matters. In the case of the OP, the contract says that there is a charge for insurance or some other issue, then the OP needs to address this through the court to nullify the contract.

    4th is I would like to see a lot of these carriers out of business but we are dealing with a lot of lazy people in our industry who should be fighting easy entry for authorities and drivers but then we are our worst enemies.

    Those are my thoughts as well.
    He hits a parked car, which should never ever happen. But then complains about some charges, instead of being grateful for not being fired.

    Actually OP why don't you explain to us how you managed to hit a car by the way. God gave you eyes for a reason, so no excuse for not seeing it. I have never hit a car, truck, building, tree, in my lifetime. I mean not even tapped a cars mirror, forget actually hitting it. Hit deer on the hwy 8 years ago coming around a sharp curve in the dark. But never ever hit anything else.
