A little confused. Just seeing if I can get some quick advice before I reach out to an attorney.
I went through a company-sponsored truck driving school starting in Feb. I signed a non-compete agreement stating I would work with ex-company for a certain amount of time. I completed the schooling and went on to work for said company. I ended up walking away due to conflict and am now seeking a new workplace. The school has the written agreement, so I called into my ex-company to see if they could lift or release me, but HR advises they "don't do that" regarding enforcing non-compete agreements, and that they have no record of it.
How do I address the school? Do I ask the school if they can release me from the non-compete or should I just go to an attorney?
Edit: I did go through and complete a company-sponsored training program.
Edit 2: I actually just spoke with a potential employer as we were going through the verification process and was advised that it is the school who is enforcing the non-compete agreement since they have a partnership with my ex-company.

Did you get a cdl? If so get a job.
Or just hire on to a carrier that will train you. Unless that is what this is about.

go out, get a job with a smaller company, be done with it.
if you do happen to owe your former employer any money for training, expect to get billed for it.
otherwise, "have CDL, will travel".....
maybe the school has that non-compete, so that you do not go to another school for job placements..????
i never really heard much of this crap, from a trades jobs, over say a corporate job, which THEY DO HAVE no-compete written into your job outline. (so you do not steal away clients when you go to your new job)

You will likely still be able to find a job. No biggie.
CRST (or is it CRE?) is about the only company that cares about enforcing it. Just find a smaller company that doesn't care.
As for getting an attorney, well the contract you voluntary signed, states you can work, you just need to pay the amount owed to get released. Some states will enforce this contract, some won'tbuddyd157, Intothesunset and chitaylor Thank this. -

California, maybe one or two other state, virtually do not allow enforcement of non-compete clauses for many non-professional jobs. That doesn't mean companies don't impose them on you and hope you ASSUME they are iron-clad and bullet-proof. To answer "does my non-compete agreement prevent me from working at another company" you need an answer from a lawyer in your state. "Some guys on the internet said 'don't worry about it' is NOT going to protect you.
This is the moment when you can start a spiral that guarantees working for terrible and dishonest companies until conditions get so bad you leave the industry. Whatever you do, get all of the info on your next employer INCLUDING TALKING TO CURRENT DRIVERS BEFORE you start with another company. What does it say on your copy of the agreement you signed. You did read and get a copy of it, right?
