I have been pulled for inspection in NM port of entry and performed level 1 . Been placed out of service for fuel leak ( driver side tank had visible leak on the bottom , i i showed officer that i just fuelled up 3 miles away and its probably overflow ) , other thing i was arguing over that my fire extinguisher didn't have specific bracket to hold , but it was next to my various bottles with liquids behind metal bracket holding it in the tool compartment . Had violation for that as well . Officer forced to have service truck come over and take care of the leak , service truck showed up , used brake cleaner to clean it and didn't find any fuel leak anywhere ( he mentioned this on the invoice , signed my report and left ) . Officer didn't even come out to recheck , looked at my paperwork signed and let me go . Can i fight it in court to have it removed ... Fire extinguisher violation is just ridiculous..

Fire extinguisher must be secured. That doesn't mean secured by other stuff that keeps it from moving. But you can DataQ the violations with documentation from the repair guy that the tank wasn't leaking. Hopefully at least get the OOS off of your csa.

I’d try and get the OOS off your record if you can. Might stand a chance of getting that done since you can document your fill up and have the mechanic signing off that he didn’t find anything. Not really much you can do about your extinguisher, other than mounting it and securing it like it’s supposed to be.

Don't argue with these guys. He dinged you because you were arguing with him.
Secure your fire extinguisher, it is not to be loose.
If you are sloppy with fueling and it looks like a leak, then ask permission to clean it and see if it is really a leak.Trucker Kev Paid Tourist, Dogman22 and blairandgretchen Thank this. -
I was actually sure that im getting clean inspection until he printed it out . Then i started arguing , i asked him if i can clean the leak and see if anything really leaking ( did my pm just last week and mechanic would never miss it ) ...

That fire extinguisher thing has surprised many a driver. I doubt you'll make that mistake again.

Dealt with the NM scales, and you definately do not have to argue or even open your mouth to get even an illegitimate violation. the fire ex, is legitimate and many dots will write you up, the fuel, well that is questionable, just not in NM. -
Btw terry looked at it and offered to tow it to their shop , drain fuel , inspect after removal and charge over 3k .... Hour later showed up offering me to buy brake cleaner i was looking for earlier ... Pos rip off artist

I think Dilion put a shop in at the truck stop, he is a furiner, but actually a pretty good dude, and fair, at least used to be. I sold him a pickup and rigged it out for a tire and service truck 10 years or so back.
I promise you that anybody thinks you have to mouth off to the dot at that scale, does not not know what they are talking about. I worked that scale over tn years and can tell you some stories. But if you do get an attitude with them, you are screwed. lol -
