Sad to say, but he had not swerved maybe he would still be alive and not had to sacrafice himself for another idiotic 4 wheeler.
Tough call to make in a split second, do you plow through the car or put it in the drink? You never know if there are kids in the car.
I am sorry for the family's loss and hope justice is served here. -
God knows if it was the other way around there would be hell to pay, justice needs to be served for driver and his family. 4 wheelers should be held to the same standars as 18 wheelers, my prayers go out to the family of the truck driver.

I have been hoping this would happen. The state of Md. did nothing to "punish" this drunk driver. Now sadly, it is time for "justice" to be serve.

I came through there that morning and sat in the backup for hours. The truck went off the shallow end of the bridge closer to the eastrn shore, just imagine if he went off on top. The bad thing is this, how much mony do you think the girl has. Her insurance policy will only cover the amount she had, and I bet the clean up took most of it. So when they sue for 7 million, who will pay?

What is a drunk? .03, I dont think so grouch. .03 is probably a beer or two. last time i checked drunk was .08. he should have just hit her. but hindsight is 20/20. -
I imagine for DUI in MD it is .08. But the girl is 19 years old and under 21 years of age. Most State's have a lessor limit for underage DUI, but my guess is this they wouldn't be able to get a manslaughter conviction or a DUI. So why waste the time, money and effort for no results. Which could also affect a civil suit. If found not guilty it could also help the girl in a civil suit, but in the civil suit the beyond a reasonable doubt doesn't apply like in a criminal trial. Anyone remember O.J. Simpson? I guess the question would have to be posed to the prosecutor

Drunk or under the influence, this girl is guilty of the truck driver's death and I certainly hope that his family wins this lawsuit.

The civil suits I have been involved with wrecks have been multi-faceted. I've seen companies lose, I seen 4 wheelers lose and I seen nobody win. The problem with most 4 wheelers (and don't shoot the messeanger) they have very limited insurance policies, unlike the minimum $750,000 policy for trucks. Haz-mat, most require $5 million dollar policy. Most 4 wheelers have a $300,000 policy. I believe some State's are lower than this, I don't know what Maryland requires, but I doubt it is a $7 million dollar policy. The only way I can see them getting any money is to sue the carriers uninsured motorist policy. Even then I don't know how much this family will be able to get.
Wyatt, I'm sure the cleanup bill was quite big. I would imagine they had to get a barge with a crane to pick it up, I doubt they used a heavy duty rotator for that one. I can not begin to guess the cost of a barge/crane and whatever else was needed to clean that mess up. Then I imagine the bridge damage was not a cheap fix either. Either way you cut it, it's a bad deal. The driver, in my opinion, acted instinctly and turned the truck away from the car and never thought about going threw the walls. I don't think I have ever heard of a truck going threw the side of a bridge and into the drink before. I know I've seen them knock the retaining walls away and have the cab hanging partially over but to fall into a body of water like that must have been a heck of an inpact and scary to witness.
