    two drunks get in a car, one drives.
    Car gets in wreck, both die.........
    passenger "deserves" what he gets????

    God forbid it ever happen to you (or someone you care about)

    So that means I shouldn't call a cab, or rely on a non-drinking friend (I have SEVERAL) for a ride?

    Can you say by by truck driving? Unless you cuz comes forward and takes the rap then it's all yours.

    Fact: You where drunk.
    Fact: You where found at the scene of an accident
    Fact: You refused a BaC test
    Fact: You hold a CDL and should know better then to get anywhere near a car driven by a drunk.

    So unless you cuz is willing to take the rap for being stupid and driving drunk. Your toast.

    In June 2001, I had only had my CDL for a short time.
    I had been home for a few months, trying to deal with some personal issues.
    I began drinking...heavily. Round about nearly a 5th a day.
    I rarely left home, but when I did, I made sure that there had been at least 8-10 hours since my last drink.
    Long story short...
    I was arrested for DUI 14 hours AFTER my last drink.
    I had eaten, slept, showered, eaten breakfast, cleaned my home, eaten lunch, then got in my car to go to Wal-Mart.
    Got pulled over for speeding in my personal vehicle.....
    STILL blew 0.22, after all the hours, food, sleep, etc.

    My point?
    Doesn't matter...your personal vehicle, your friends, etc. et al ...
    ya got no business driving a truck, if you have issues with drinking...

    I'm GLAD my CDL was yanked.
    It has made it so much more satisfactory to prove myself WORTHY, once again, to drive.

    My point?
    OWN UP...
    BE A MAN...

    SET THINGS RIGHT..

    FOR YOURSELF.

    GA, just as most states, has an Implied Consent law. Simplistically, these laws state that as a condition of receiving the privilege to drive, and it is legally a privilege (you do not have the absolute right to drive), the state implies that you must take a breath-a-lizer test when asked. You have the right to refuse, but once you do you will lose your license for refusing. So you may not only be convicted of DUI, depending on the laws of the state, but you may also lose your license for the implied consent law as well.

    In addition, I suggest you also read 49 CFR part 383.51 in your little motor carrier hand book as there are also some things in there that may be appropriate. It is rather lengthy so I won't post it but as a CDL holder it becomes very important to you now.

    The reason I said what I did is because too many people claim that they will call a taxi or a non-drinking friend is they need a ride, BUT they don't and then decide they are okay enough to drive.

    The boy who killed our son decided he was okay to drive home, after drinking at a local bar, and apparently from the things we have heard, had driven drunk before, only this particular time he killed someone.

    So yes, imho based on my experience and the unreliablity of people to do what they say they will do, yes that person who wants to drink needs to just go to where they plan on drinking and stay put until they are completely sober again.

    This saves that individual the hassles of trying to find a ride home or to where ever at a strange hour, or any hour, and it lessens the likelyhood someone will be killed due to someone driving drunk, it doesn't completely prevent a drunk from doing something stupid, but at least it keeps one off the road.

    Personally I don't see a whole lot wrong with drinking in and of itself, I just see a whole lot wrong with anyone deciding to drive after drinking because when they do it's only a matter of time before someone is killed or severly injured, and that could even be the person who is driving drunk.

    If someone wants to go out drinking, then why don't they just call a taxi way ahead of time and make arrangements to be picked up a the time they set to go home. That way they don't have to be looking up taxi numbers later, also if someone wants to call a friend then call them ahead of time so that friend knows to come pick you up at whatever time you schedule ahead of time. That would be better imho than waiting until after you have been drinking a while.

    Also something else to think about I have seen some people who were drunk who were completely belligerent (sp) and basically would act like complete idiots, and would make it very hard for someone to even drive with that person in the car. So it would be safer for all involved for someone who is sloppy drunk to just stay wherever they are until they sober up, and if they can't act decent a cage would be a good place to put them.

    That's just my opinion based on the fact my son was killed by a drunk who still does not believe he has done anything wrong, several of my husbands relatives were killed by drunks, the one who killed his sister was a habitual drunk.

    Your entitled to your opinion, but remember that when you find your child or another relative or close friend after they have been killed by a drunk driver, you may wish that the drunk who killed your loved one had of been in a cage even if that drunk so happened to be you.

    When I was in highschool there was a man who came home, drunk, he made it all the way from wherever he was to his home, all the way into his driveway, the next morning when he sobered up and went out to the car, he found out he had ran over his son, his son was dead. I'm pretty sure that when that man found his son, he would of been happy if someone would of put him in a cage to prevent him from driving drunk, because he killed his own son in his driveway.

    If someone wants to go get drunk or just drink a few drinks, fine, just plan well enough ahead that you know there is no possible way that you're going to do something that you will regret the rest of your life.

    Just ask Donte Stallworth. Hits and kills a man while driving drunk. Pleads guilty...his sentence...30 days in jail, 2 years of house arrest...but he can still play football...8 years probation, 1,000 hours of community service and loss of drivers license for life. 30 days in jail for killing an innocent human being...unbelieveable! Now you tell me there isn't a different set of laws for people with deeper pockets.

    However, one must always remember, even if one has deep pockets, to never try and rip-off those with deeper pockets.......(right, Bernie?).

    Nothing will piss a FF, EMT or PO off more than stumbling around in the dark for hours looking for a non existent body. And then finding out they could have been home this whole time in a warm bed asleep if it wasn't for this other idiot lying to cover his butt.
    I understand your rage. Couple weeks ago I nearly lost my brother and nephew to a drunk........ in the middle of the afternoon on a clear, sunny day.
    I was pissed for several days, over what could have been.
