It wouldn't have turned out any different because the problem was ( and always will be ) that when they " deregulated " the industry they ( the government, who are honestly blind and are ignorant of how blind they are ) they threw the transportation industry into the race to the bottom. They didn't lift any burden of compliance at ALL, while simultaneously lowering the bar to entry into the free for all blood letting struggle for a short term customer.
The very very few long term customers left are fully aware that the relationship between them and their transportation provider is a important long term commitment. Like SPD has with the aviation field. There's extremely little competition is the commercial and military aviation industry and what there is, is from overseas based companies.
Therefore it's a skewed picture of the Trucking industry as a whole.
Walmart just tried to slash and burn their own supply line as a way of increasing their profit.
They found out that it wasn't nearly as easy as they thought.
In every single business transaction, regardless of what industry it is in, both parties Must be able and allowed to cover the cost and have a portion left over. It doesn't matter what other parameters are in place, that is a hard and fast rule of business.
    It's pitifully simple.
The disgusting thing is there are so many people in charge of decisions that don't understand that.

There's plenty of decision makers who will ALWAYS take the bottom offer without regard for how they can cover the next load after they forced the best provider out of service.

Now back to the HOS thing, it wouldn't have mattered where the limit was set. 40 hours. 90 hours. The stupidity of the decision makers ( dispatch and the customer who has NO idea ( and doesn't have ANY concern about safety ) about how to value the effort they need to have done ) will constantly take the bottom offer. With rare exceptions.
So dispatch would constantly push the workers to bend the rules. No matter what the rules are.

Human nature is what it is.

Oh, I know. It's the megas trying to make the industry a level playing field. But even the reason why there are HOS regs in the first place are the cowboys pressing their luck and running way over the limit.

Even my new boss knows the advantages of paper, but tells her O/O's she doesn't want them pushing the envelope because it's not worth it in the end if something bad happens. It's all for flexibility, which the Elog doesn't offer. As a company driver, I wouldn't use anything besides the elog, it keeps everyone accountable and protects me from company overreach. But if I own the truck? It'll be paper or nothing.
