i am making this a separate thread. i find the way it is setup a little absurd, why do we have to put up with it? i showed no signs of intoxication that day. i had someone run into me. i had to prove my innocence. i had to submit to a drug and alcohol tests. if the truck driver clearly did not cause the accident why are we under suspicion? this is nothing more then nonsense used in an attempt to push the blame off onto the trucker when the trucker was NEVER the cause. if i smoked on my day off but was NOT intoxicated at the time of the accident ( i do NOT clearly) suddenly i am to blame? NOTHING changes the FACT that he ran the stop sign. i don't know why we have to tolerate this. its all about insurance nonsense, if i had any trace residual in my system suddenly the man that causes the accident gets out of having his insurance pay for the mess. this is why it is so important not to do these things while you are an active truck driver, at least until the federal law changes.

I guess if your test came up hot, the claim could be made that the accident was preventable or that you were partially at fault because you may have been under the influence at the time of the accident. I'm just guessing though.

I do not disagree with testing the truck driver, but...

Gotta love the sue happy motoring public for that. Trucking companies just wanna cover their ### in the event of an accident. My trainer had a drunk driver slam into his trailer a couple years ago, sent my trainer for a drug and alcohol test. Such horse crap.

By law, every driver must be enrolled in a random drug test before they can drive for the hiring company or face fines of $10k per day for non compliance. After an accident regardless of fault, driver may be required to submit to the random drug test.
As a commercial driver, we have very little rights. If cops wants to search our truck without warrant, they can. If they want us to take an alcohol test, we must not refuse. We do have a choice. Walk away from commercial driving and do different kind of work. Or, stay in trucking and take the abuse.Intothesunset, brysol01, Long FLD and 4 others Thank this. -
