Secondly it don't matter if the police says the other party is at fault. The other party probably will lawyer up and the insurance may want to come after you. I would seriously consult legal advice never mind you didn't have insurance at the time. They must prove your intent on not having sufficient coverage. In discovery if it goes that far the attorney can capture a financial profile to find out if this is a fraud case. Take your case to the most popular ambulance chaser; if they take you on then you might have a shot.

You need to Hope the car lot went and got you a very hi priced full coverage insur. when they got the notice of no insur. and your next car payment will be much higher?
