I'm thinking these are two way separate animals.

The bill about the trucking issue is very detailed about trucking.

I know guys that wanted to be IC's, or O/O leased onto a company, that could qualify, flocked to Landstar.

Perhaps because they have 0 company drivers. So the chances of being misclassified are also 0.

They have the billion dollar legal team. When they say no one from California, then I'll say it's real.

 

It applies to all 1099 contractors ... The bill itself doesn't specify an industry. It defines the test of what is an employee and what is a single proprietor business.

Uber has just become the face of issue. 20 years ago, it was Google.

Under the strictest interpretation of the test, even an O/O, with authority, pulling for brokers could be considered an employee of the broker, if the broker has thier own trucks.

 

Well. I'm not an attorney. Maybe you are. When the legal department says no, then I'll worry about it.

Because the truth of it, is it doesn't matter. If the OP isn't capable of doing his own due diligence directly with the principles he's going to crash and burn anyway.

 

I have researched all I can, but there are always unknown variables that make it prudent to ask others as well. A spreadsheet can only give a part of the picture.
