Disclosing Accident

    Am I legally required to disclose a rear-end collision -- no fatalities, no conviction -- on a CDL A job application when the accident does not appear on my MVR? Caveat: An accident report was filed with CO State patrol for insurance purposes. CDL applications generally ask "have you been in any accidents?" Can I state "no" when the accident does not appear on my MVR?

    They will be checking your job history with a previous employer. Your accident will be on record there.

    If it's not on your MVR and it's not on your DAC how is one to know? But nowadays it's always good to disclose everything upfront. If they ask for accidents, make sure you put down that it was "non-preventable" if there is nothing on your record...
    How long ago was the accident?

    2.5 yrs ago. Every employer I have applied with has immediately disqualified me based on this accident, which is why I am wanting to know if I have to disclose it. Everyone wants zero accidents within the past three years - regardless of fault.

    Interesting question - in theory you could get away with it (not advising here just commenting) but all it takes is for some thorough (or overzealous) company to check with the law enforcement agencies in the states you've worked and then you're toast. How long ago was it?

    I am also in your position - 20-30 years ago I was in something similar to a DUI, but back then they did not call it that. After the lawyers finished with it - I have no idea what they plea bargained or what the judge did. I think the fine was $250, maybe $500. The lawyer was 3,500 or 5,550. I don't even no when as in what year. I don't even think my license was revoked - think I would of remembered not driving a car if it was.

    How do I explain this to a company - "I might have - I really don't know." The school I am at now told me not to worry about it and leave it off the application as May Trucking only goes back 10 years. She figured it would be the same or similar time frames with the other trucking companies. Nothing shows up on my DAC - but that might be that I am really not a CDL holder, just a permit. The Colorado background check is clean - lived here for the last 12-15 years. Any advice?
