Payroll Deduction scam

    Hi folks,

    I am supposed to go to orientation tomorrow for a mega. After reviewing their HR paperwork, among other inflated questionable deductions. This is the one that is really scary!!!

    Truck damage due to driver negligence Actual charges Based on repair estimate

    Legally this essentially means I will be their physical damage insurance on their equipment. There is no way in hell I am signing this. What do you folks suggest I do. Show up to orientation and tell them if you want me to start working here take out all of these deductions or simply just don't show up. I seriously doubt that the mega carrier is going to negotiate their unreasonable payroll deductions though I am not an attorney this also implies liability on my part for just about anything under the sun.

    The place is about 30 mins from my house. I never thought they would have such a scary clause hidden in their payroll deduction or I would have discussed with them since Wednesday but here I am.

    On another note, if this is the norm for Trucking companies, let me gladly join the 95+% turnover rate and drop out of this scam called trucking.

    In many states it’s illegal to deduct from payroll regardless of what you sign.. Find out if yours is one and if it is don’t worry

    In this case it’s not just trucking it’s almost any job that you’re driving a company vehicle will have fine print protecting themselves from driver neglect to their equipment. You gotta put yourself in your employers shoes. If your a good reliable driver chances are if you rip off a trailer door one time you won’t be charged. My wife owns 7 box trucks and the employees get deducted exact cost of any major damage. Just like any smart trucking company you never put claims on your insurance unless you absolutely have too.

    I beg to differ with you. If I do something wrong inadvertently, you can fire me. Otherwise, no way in the world I am signing this. There is nothing that anyone can say to convince me to sign one of these. The only thing I hope to hear that there are places that don't have this scandalous stipulation in their payroll deductions.

    @magoo68 I am in Texas anything goes here. So I doubt if state of Texas is going to provide me much of a protection.

    I already sent them an email, I am not signing this period. More than likely they are not negotiable. So the only question should I show up to orientation have it show up on my DAC or discuss it with them first thing in the morning.

    I've never had the sign anything like that. Like @magoo68 said if the law is one your side then I guess it doesn't matter but I would definitely check first before signing. I also wanna give you a pat on the back and a ata boy for actually reading what they are asking you to sign instead of being like the countless other people that come on here asking for advice after they signed a bunch of crap without reading it.

    Yep, had a company hide this until after I'd done some training and then gone through a couple inches of paperwork with HR. It was like they were counting on decision fatigue to get me to sign it anyway.

    The language was wide open, no caps, just trust them to be fair. They wouldn't change the language and then didn't pay me for 30 hours of training time. So I guess I should've trusted them with my financial future.

    Walked out. They are constantly advertising for drivers. There are people who just want everything their way. @DillonJ you are lucky to have found out early, cross them off.

    Here is the full list. I mean they can pretty much make me work for free and take any savings I have.

    Abandonment of truck $500.00
    Charge for locking keys in the truck $75.00
    Employee benefits costs (based on employee selections) Actual charges unpaid premiums
    MVR, Physical, and Drug & Alcohol Test $100.00 Within 90 days from Date of Hire
    Other citations (based on amount fined) $150.00 Minimum Overweight fines (based on amount fined) $175.00 Minimum Parking citations (based on amount fined) $100.00 Minimum Passenger insurance per month $27.00 Pet deposit (non-refundable) $500.00
    Tow bill fees, when driver is at fault $350.00
    Minimum Traffic citations (depending on state charges) $1 to $500.00
    Truck clean up fees, exclusive of ordinary wear and tear $250.00 Truck damage due to driver negligence Actual charges Based on repair estimate

    I would call them tomorrow before showing up. They may not force you to sign it.

    I had a previous employer try exactly the same thing at my orientation. I noticed it in the pile of forms I was signing. I handed the stack back to HR and told them I was sorry it wasn't going to work out and I left. The guy that hired me came running out, and when I told him why, he said that I didn't have to sign it and they hired me.

    Carriers have insurance for a reason. Attempting to squeeze accidental damage costs from employees is just crazy.
