Will marijuana possession impact your CDL?

    It's a state issued license... it's not Federal.

    Anyway, let's have a look...

    Disqualifying Offenses

    Major offenses require a minimum disqualification of one year and include the following:

    • Driving under the influence of alcohol as prescribed by State law.
    • Driving under the influence of a controlled substance.
    • Having an alcohol concentration of .04 or greater while operating a CMV.
    • Refusing to take an alcohol test as required by implied consent laws or regulations.
    • Leaving the scene of an accident.
    • Using the vehicle to commit a felony.
    • Driving a CMV while revoked, suspended, canceled or disqualified as a result of prior violations committed while operating a CMV.
    • Causing a fatality through the negligent operation of a CMV.
    • Using the vehicle in the commission of a felony involving the manufacturing, distributing, or dispensing of a controlled substance (mandatory lifetime disqualification).

    Ok, so let's see what the feds say about possession of marijuana while not operating a CMV...

    *crickets*

    The regulation is clear, the regulation pertains to the use, or possession of, in relation to, the operation of a CMV.

    Didn't transport in a CMV?

    No suspension of your CDL...

    The regulation applies to use and possession involving a CMV...

    In the Eyes of DEA schedule one is of no medical value. Any ER doctor prescribing say Ketamine (Which really takes the patient out of the current reality) will have to write a letter defending dosing a patient with it.

    To me I believe that if God grew it on the earth for us to use naturally then let it be. Coca Leaves for example when chewed gives a boost to those who may have trouble 2 miles up on a mountain. There is only one way to get coca leaf in the USA and that's via Coca Cola in New Jersey, Import facility. They remove the cocaine from that leaf before using it to mix the soda drink we like.

    Regarding the other posters state postings, I believe it. However CDL means CMV means no pot period. Its a extreme form of thinking.

    To yet another poster regarding scripts electronically, yes, in the past this year some of my common medicines like tandadine for muscle knots are sent electronically to the pharmacy here in my county. However narcotics are given after notarized and entry into PMB at the clinic by the prescribing doctor to your hands. Up to two months only. YOU drive to the pharmacy hand deliver that to them with YOUR signature on the back.

    Im PRN meaning as needed. Many patients do not have that luxury being under a lawful and legally binding pain contract which requires them to have the correct dose against the next refill date at all times. If they get counted and come up short then it's a charge of diversion, sales and or abuse with appropriate action taken fairly quickly.

    You will find that no family practice doctor, dentist common, walk in clinic, VA clinics etc will prescribe Narcotics. None. ZIP zero. It does not matter if you busted your leg say and had half the bone sticking out in agony. They refer you to the ER for that or a pain center for everything else.

    MJ products like CBD done right does help quite a bit in my case. I don't need that bottle on the medicine cabinet.

    It will be a generation or two before MJ is taken off Schedule one and legalized for either pleasure or medicine. I don't know what kind of society we will be at that point but we'll see.

    Everyone I know that goes to Colorado or Vegas packs a Priority Mail box, affixes postage and lets USPS do the work. It's another charge if you get caught but it seems to be the method of choice.

    Know a highschool kid? Even if they don't use it they know who does. No need to go all the way to CO when you can get some pot brownies or cookies locally fairly easy. It's not like your trying to source nuclear materials. It's weed and it's everywhere.

    I know several people in Texas that smoke pot and they never have any problems getting it. A quick online search will yield dozens of recipes for making edibles. Just sayin'.

    Isn't texas right next to Mexico? You cant find weed in texas? I mean how hard could it be? And buying it illegally in texas any worse than driving it illegally from Colorado?
