Fired for drinking off duty

    From what i understood - my megacorps policy on drinking was no drinking within 24hrs of driving or being able to accept a load.

    I have a phone recording discussing me going on home time after i arrived at the home terminal to drop off the student.

    We arrived at the terminal friday night.

    Had a beer Saturday morning, and waited around to check check the student in monday.

    Then was to be going home.

    Fired for violating company alcohol policy... unless they changed it, that's what was in existence when i was hired.

    Mind you that's with off duty, not going anywhere, followed by home time factored in... im not seeing the problem

    The screwed up part is i didn't even drink. Guy said he smelled something, guard checked me out after knocking on the (wasn't move this truck ever, offduty+not moving+hometime) truck to check me out.

    That guard smelled no alcohol, found nothing in the vehicle.

    I told him i didnt drink, he then asked "so where did you go"
    I was apprehensive to answering where i went (at Saturday night) as ive read no carrier is suppose to ask you about what your doing in your off duty time - let alone bother you.
    I went to walmart to buy another atlas, i couldn't find one, i drove to walmart, 2 gas stations - where you could see me on camera -
    The guard then began recording, he suggested i went to applebees
    I answered "yeah sure, whatever"

    I have never been to an applebees and i can promise me or my vehicle never entered the property.

    The guard literally put words in my mouth while recording.

    And i was suspicious yet, to my knowledge i was still in the clear.

    Then i am told, talk to irc monday, then i am told i was suspended, then i was told i was fired after i gave my statement stating that i never drank and never went to applebees.


    Im pissed...

    What do i do now?

    None of anybody's biz what I do on my off time as long as it's legal and I'm sober when I start my job .

    I'm certainly not waiting 24 hours to have a beer.

    I'll wait 24 hours AFTER the beer though.

    If the company won't let you drink on your OFF time. They're not worth working for.

    Same goes with pot. LOL. -- JK.

    You're fired, so find another job.
    First you talked too much with the details.
    Should have just stuck with, "I don't drink."
    It's no ones business what you did during "off duty."
    If you weren't blood tested or breath tested for alcohol, then you didn't have a beer. Furthermore, it's been years since you had a beer.

    You didn't get fired for drinking. You got fired for drinking "In the truck" That last part is the important, and very common in megas.

    Good thing is if it's reported it will simply be "violation of company policy" so do alcohol related issue on record.

    You started off with I don';t drink then got lured like a hungry cat fish into naming places you don't are about but not realize that these are alcohol places everyone knows about. You exposed yourself way too much with that talkative mouth particularly when you stated you no longer cared about the situation overall while digging deeper against yourself.

    I used to drink and drive around semis early in my life time as a means of coping with the old spring suspension (It aint...) and old time concrete pavement blocks which really inflict pain. You just kept a small bottle of say spearmint schnapps and drank a shot every 40 minutes. Drinking slowly. (DeKryper) Boss man generally did not see me again at home until I have had enough time to get sober. There was a family friend who would run a penlight against my eyes ss

    Those days died with the introduction and enforcement associated with the new CDL's after 1991. For me Judgement day was April, last day of month 1994 for renewing the old Class A which I was still valid for but waited until the very last day to be required to either renew it or get revoked which is a very bad thing as of Midnight.

    I also disposed of friends who kept generating situations where excessive drinking was common. Kicking my old reefer across the jangling GWB while double hungoer was a interesting trip. Not doing that again, did not think my hearing was that good.

    (*Fast forward to earlier the hearing survey detected and did confirm at anywhere below 750 hertz my hearing had no loss whatsover. Which is one of the reasons I enjoyed sounds with a low pitch.) Anything above that required hearing aid support of some quality as it always has been most of my life. The differences being the technology being able to see where I am.

    Bottom line like Chinatown said. Yer fired.

    Off duty is your time. Best be gone. As we used to say to get really scarce and hard to find. Hard enough that the Boss will pull a couple of more easier to find employees from the river to get a load going.
