Beware crooked Mercer!

    Ya i looked it up last night. Until the case is over there wont be a clear pic. Im sure the op believes he is right or he wouldnt have counter sued (giving him the benefit of the doubt) but where would we be if we took every truck driver story at face value? Id prefer to reserve judgement when the case is over.

    At least in the OP’s case he has the case number to back up his claim-rarity on the forums. I also noticed there were a few case files in that particular court with Mercer’s name written all over them,which necessarily doesn’t bode well for that company.

    Yes the next hearing is regarding Mercer’s motion for a writ of possession. They are no longer confident they will win the case so they are asking the judge to order me to surrender the trailer while the case is pending. Of course they have no grounds for the writ so it will be denied. The other issue is my motion to compel production because Mercer still refuses to hand over the contracts for my loads. The court has been patient with them up to this point but that is about to come to and end. Feel free to read my motion. I have attached it here. My goal is to educate my fellow truckers. We are not as powerless as the trucking companies want us to believe.

    I've said before that some Shady stuff definitely has been going on with Mercer and drivers pay/rates. Of course I got flamed by the koolaid drinkers...

    Just out of curiosity did you ever haul any loads for CHI, CWC or the Atlanta office?

    I hauled for all of them. The worst was that Ricky guy out of NOLA office. Real scumbag. Never ever paid accessorials. Told my coordinator not to bother offering his loads to me.

    No that’s not correct. Each party is responsible for their own legal costs unless you can prove to the court that the case was frivolous and filed just to harass. So if you feel you have been wronged don’t be afraid to sue because you think you will be ordered to pay the other guys legal bills. As long as your claim has even a crumb of credibility you will be fine.

    I believe it. Had more than one load out of the CHI office disappear while deadheading to pick it up. Only to find out it was given to someone else under mysterious circumstances. First in first out my ###. It’s who’s got the connections that gets serviced best and first.
