As in, when you get a subpoena I “suggest” you comply or the court will hand you your arse. But in all seriousness there is no subpoena in this case. A subpoena and a request for production of documents are two different things. A subpoena is an order from the court to someone not a party to the case to do or not do a specific thing.Last edited: Dec 15, 2019

I certainly appreciate the transparency of putting this out there. It is important that us driver's become more knowledgeable about our rights and the law.
I too have sued a mega company and have current cases that I am suing 2 different companies. It may not be a good idea to put this information out here until the case is over. Subpoenas are ORDERS (or summonses) issued by government agencies which people/organizations are MANDATED to comply with or face punishment. In Mercer’s case,they’re looking at contempt of court and possibly any additional sanctions!drvrtech77, Lonesome, dwells40 and 1 other person Thank this. -

They are most likely challenging the subpoena. There is no basis in law that the actual contract with a customer be made available to us. We are entitled to copies of freight bills and supporting documents such as rate confirmations with brokered freight, but not the actual contracts with the customer. This is all spelled out by the fmcsa in the truth in leasing regs.roshea Thanks this.
