Well not exactly. When I first signed on I did so with the intent of getting a trailer AND seeing if I would like being leased on so I wouldn’t have to do all the administrative duties that come with having your own operating authority. It’s a lot of extra work. But I knew after the first year I wasn’t going to be staying. The first time I was summoned to the safety directors office so he could discuss with me the few times I went 15 minutes over my allotted logbook hours I knew it was finished. Over 20 years of driving with no tickets or accidents I don’t need some pencil neck sitting behind a desk telling me how to drive.

Len a pencil neck? That man has been in trucking longer than most drivers have been out of diapers.

I don’t know who he was nor do I remember his name. All I know is he was some guy sitting behind a desk and I had just come in off the road. All I knew was it after that conversation there was no longer any doubt I could not handle being leased to any trucking company and I would have to go back to operating under my own authority.

So if Mercer main office contracts a load for $1000
The main office takes $100 for administrative fees, then gives load to logistics with a value of $900 to broker to drivers.
Which amount do you get the 75,% of 99%.

    Interesting post.

    Good luck.

I must say, this is one of the best threads of all time. Keep it going people, because I am entertained and educated all in one. Please folks, dont do anything to get this shut down. I want to see what's going to happen with this case.

And chances are the authorities have their number-their inmate number!;)

Just because they don’t get you now doesn’t mean they won’t get you somewhere down the line.

Since you felt the need to edit your post ill go ahead and respond to what you added.

If you read the beginning of this thread it is obvious it had nothing to do with education or civil courts, only #####ing about mercer so at least drop the fake im doing this all for you guys act.

As for the word subpoena, ok i used the word and posted it about the same time you were posting to correct the language and i had already picked it up.

I understand that you need docs from mercer to show you were paid improperly and i have made no statement of whether you were or werent. I simply pointed out at this point theres nothing youve presented that makes more than the same allegation that goes around at every company that pays on a percentage basis.

Whether mercer canned you or you quit, you have left mercer so not sure why that matters.

As for the trailer, youre just playing a game with it. Mercer buys trailers through wells fargo and leases them to drivers. Just because you dont have a copy of the contract between them does not mean its not mercers trailer. The contract you do have is the one you signed that includes language about the trailer having to stay at mercer until paid for and offers ways to keep it if you wish. Therefore you knew mercers terms at the time you signed it. Its entirely possible some part of that violates kentucky law and could be struck down by the judge, but just because he hasnt ruled on it yet does not mean he agrees with you. Since you saw the terms before getting the trailer, you are either playing a game or intended on doing this from the beginning and didnt care what the terms were. I prefer not to think the latter but considering the number of carriers/brokers you have mentioned sueing elsewhere, it could be a possibilty.

And lastly, my point was you didnt go after mercer at all. You just reacted when the came after you. Puts your motives in question.

My post was only to point out some issues with whats happening in the conversation. Your need to make a personal, childish attack changed it. If you are not wanting to hear issues with what youre doing, shouldnt have brought the details to a public forum.

Your inferences of what I said are your opinions only, I cannot help if your interpretation of what I said is different than what I meant. Your inference of my intent, does not change what I meant.

Consider this, you have paid attention to the meaning of words and interpretations of regulations. You have stated clearly the trailer in question is not Mercer's but is owned by Wells Fargo. However, you have also clearly stated "my trailer" multiple times. By your own reasoning just as it is not Mercer's trailer, it is also not your trailer. Should I or anyone else draw a conclusion (inference) from that, that you are a liar, based on that one statement?
