To me even if it is a 15% chance you will win it is worth fighting. We are talking about a driver's career and livelihood. I make #### near close to 6 figures and if I didnt guard my license with my life I probably wouldnt have qualified for the position I currently hold.

Sounds like you didnt have a lawyer and if you did he got his bar license from a cereal box.

A judge should never be hearing YOUR explanation. It should always be your lawyer's explanation speaking for you.

Overweight tickets don’t affect the carrier’s CSA score. And if the op is an employee he doesn’t have a score of any kind.

With all due respect, a trucker doesn't guard their CDL by acting the fool, not paying attention then going off halfcocked and trying to after the fact change the outcome of their actions. A Professional Truck driver worth their weight in diesel will take the proper steps to AVOID these situations by following the law and using due care in unfamiliar places. That is a mantra I lived by everyday I held a CDL. I really only fought a case 4 times in my life. and in those, I am 2 wins out of 4. In every case, I was innocent of the charge. "Fighting" every case is in fact a poor way to drive. If the driver is really innocent and there is an important point I agree, fight the charge. However, in the case of an OTR driver hundreds of miles from home, even if they win (which is less then 1% nowhere near 15%) you still have the lost time and the expenses of getting to court PLUS in almost every case you will be forced to make that trip at least 2 times.

I see no further need to comment anymore because to do so will be to just go round in round in circles. If a driver wants to toss money away like this all power to them, I will always council taking stock of where you are and finding the best least expensive way out. AND this most of the time does NOT mean fighting a almost hopeless cause!

This is exactly why I made the point of lawyers make it worse. Fine went up because of additude toward court not “admitting guilt.”

Oh gosh yes, In fact, there are several State Judges right here near me that have had open loud arguments with Attorneys. This is really a problem with divorce cases. I have a really good friend that is married to a Naval officer and used to live in the Atlanta area. During her divorce case Her now Ex husband's attorney called the Judge a "donkey" after he made his decision on the marital property. In fact some of the most entertaining things you can see are Judges and Attorney's go after it in court!!

Overweight citations bear no points for a carriers CSA score. And an employee driver has no score. The PSP only shows violations. Please show me otherwise.

Thank you @Long FLD for posting that. I had a computer hard drive failure and did not have a lot of my DOT and FMCSA information links saved.

You may be right about the overweight ticket. But to say an employee doesnt have a score is misleading at best.

All csa violations go to the carrier as a csa safety score, and the driver as a psp score.

Wow you fought a case 4 times? I've only fought a case once. If I had your attitude I'd be telling you that you dont deserve another chance.

Take it easy driver, everyone needs to make a living and you ain't perfect.
