The carrier has a CSA score. There are no points associated with the driver. The PSP only shows violations and they have no points with them.

HazmatTanker Thanks this. -

Over my lifetime I fought 4 cases. One in SC, 2 in Georgia and another in Texas. I came close to fighting one in Florida but the court changed the charge and I paid a fine for a none moving violation. It was just based on some quick and dirty figures going to cost me close to $3,000 in lost time, attorney fees and travel expenses. Just to avoid a $75 dollar fine. As to taking it easy? I have epilepsy and the state of Virginia has stripped me of my DL. Heck, I was warned against pulling a George Jones. So I have a doubt I will ever be in a traffic court ever again.

Was there a sign that showed the weight restriction?
Was the sign at the approach road intersection, or in such a place or places where you could have detoured or taken an alternate route?
Was the sign placed where you had adequate time to make a proper response?
If you answered "No" to any of those questions, you are innocent. The proper placement of signs are covered in the MUTCD (Manual on Uniform Traffic Control Devices} in the 2B section.
I have a thread on here about me beating an overweight ticket on a weight restricted road.Last edited: Dec 22, 2019
Truckermania and PE_T Thank this. -
Ignorance IS an excuse if the road is not clearly marked, and appropriately marked.
-
Try and get out of a frost law restriction in the spring in MI with that excuse. The judge will simply say "You should have looked on the county's website first."
That's not even mentioning when it's simply not marked but still has a restriction. -
That's simply not true. All 50 states have adopted and follow the MUTCD, the MUTCD dictates how, where and why traffic control devices should be placed... signs are mandatory.
-
Except in MI during frost laws.... Well at least I know several people with the citations stating as such....
I'm not going to argue it should be one way, but during frost law season it doesn't have to be marked. -
I don't know anything about Michigan frost laws. I know about weight restricted roads, or "No Trucks" or "No HM" laws. The MUTCD clearly states that restriction signs are to be placed in advance of the restriction, or approach road intersection, or places where the prohibited vehicle can either detour or turn around.
