Moving truck in shipper/ consignee lot after 14 hours

    I was always under the impression that if you were driving on private property (shipper, reciever, company yard, whatever), and remained on that property, then truck movement could be logged on line 4 (On Duty, Not Driving). And you only have to "line and log" change of duty status if it's more than 7.5 minutes. Under 7.5 minutes just needs flagged in the "Remarks" section at the appropriate time. But I could be wrong. 2 years of driving under both the old 10/8 rules and the current rules have left me kinda fuzzy on some of this stuff.

    True, but such a log entry voids the 10 hour break.

    That would be my first and last day working for that company! These guys must have to ask for permission to take a dump. What is the point of even being a trucker if you're stuck in a way like that?

    Oh yeah, forgot about that. But I gotta admit, I rarely logged moving my truck off the dock and into a parking spot, anyway. Wrong, I know. But a matter of convenience for me. Quicker I can get my mandatory break done (since I normally only sleep 6 or 7 hours under normal driving conditions), quicker I can do my pre-trip and get underway. Might not be the right attitude, but that's what works for me. And I make an effort to remain safe in my driving. Always try to get enough rest, DEFINITLY watch my following distance, watch my speed (like that's an issue in most company trucks, haha!), and plan my trips out before hand. What more can somebody ask?

    I'd never log anything that I do at a shipper other than the minimum. I dont care if your there for the better part of the day and drive around the building 47 times and it takes you 2hrs. Log that nonsence and your just wasting your time and money.

    Does anyone want to help me out on this? What is the rule, ruling, or guidance that would allow a driver to drive on private property after traveling for 11 or working after 14th hour.

    I am not doubting anybody; I myself have gone by this idea but I have not had any luck finding the legal justification for it. Any help would be appreciated.

    To contradict this line of thought, another driver brought this up to me:

    "§395.2 Definitions.

    Driving time means all time spent at the driving controls of a commercial motor vehicle in operation."

    This definition under the rules of HOS of service would seem preclude operation of CMV on private property as anything other than driving.

    federal definitions seem to go in circles. however, no federal definition states where you drive the cmv, they only define what a cmv is or isn't. and, even on private property you are still operating a cmv by design and capacities, and by definition you are still a driver of said vehicle. also, if you have a haz-mat endorsement and your vehicle is designed to or is carrying haz-mat, that vehicle must comply with the federal rules of a commercial vehicle. not only on the public roadway, but anywhere it will be "operated".

    Once again I have to sound like an arse.

    CALL THE COMPANY AND ASK THEM!

    They are the ones you have to answer to!

    Why ask 2 million drivers from 1 million different companies that will have 3 million different answers! You have so far gotten 6 different answers and not a one actually gave you advice you could use! Really, in this case, call the company and talk to safety as they will give you the answer you must have for this company! It could change when you go some where else!

    Now MY outlook on this. You didn't get on a street and it took you less than 7 minutes to drive across a parking lot (I hope LOL) so unless you have a log that is broken down into minutes instead (yes JJ Keller has them!) of quarter hours you can't or would not go to line 3 but you are actually on line 4 due to still taping. Remember you can work (line 4) past the 14 hour mark. You just can't drive so I would say as long as after you went to line 1 and took your 10 you were good. Just remember this is number 7 kind of a helpful post and still different from the other 6 "helping posts!"
    You were just lucky to be somewhere that you could park over night at! They are becoming rare!
