The grapevine claimed my CDL

    Hi all,

    Well I'm in a pickle here and need a little info.

    While in California doing a 5 stop load, I got a ticket going downhill on the I5 Grapevine. Officer put down 65 in a 35 though I know I wasn't doing that. How? I had cruise set to 55 and when I do any mountains, I take cruise off, get in gear beforehand and jake it all the way down. I don't use brakes unless to feather it, just jakes, so I always take mountains slow.

    Welp, before I had a chance to do any of that, cop pulls me over.

    Granted, the sign says 35 and it's my fault. Unfortunately, I was paying attention to the traffic ahead of me and preparing to break it down when the cop signalled me. I quickly pulled over, didn't say anything and politely took my ticket during the stop. The cop hung around and kept looking at me like he was waiting for me to say something afterwards.

    Any suggestions on how to avoid this from taking my license? I plan to fight it as I'm a single mom and would rather pay $$$ to keep my CDL intact (no previous tickets) than lose it over 1 serious ticket.

    After finally getting a moment to review my ticket, it actually shows 55 in a 35. Still bad but it looks like the officer had rewrote over my copy and I only saw the first copy he took with him. Hmmm... Why would he write another number over my copy? I'm assuming he just didn't want to rewrite everything again. Also if he used radar, why change the speed? It seems like guessing. Well off to a lawyer.

    For those that say I'm a numbnuts for getting it. Your right, I'm beating myself up over it because no matter HOW you drive your truck and know it, that's no excuse. Hopefully it works out or I'm back to working in the corporate world for peanuts.

    Find a traffic lawyer close to the courthouse, and ask their advice.
    All you're going to get here is a load of abuse for your very poor driving.

    Spend the money for a good attorney and fight it. Your career depends on it. A ticket that high is considered reckless operation, and not many companies will hire you because their insurance company won't permit it. Regardless if you were preparing to go down the grapevine or not, doing 65 in California is just begging for a ticket.The statewide speed limit for trucks is 55.

    Another driver blaming their lack of driving ability on inanimate objects.

    Here's a hint to keep in mind if you get past this. The Grapevine didn't do anything. Your lack of paying attention to the speed is 100% the cause of your problems.

    65 in 55 wouldn't be so bad.

    65 on that 35 downhill though.

    Contact roadlaw or interstatetruckers.
    I used roadlaw. I was 55 on that 35. Paid the fine plus lawyer. It was changed to logbook violation.

    Dont worry too much. No matter how bad of a driver you are there is always someone that'll hire you. A seat for every ###.

    This guy did this 3x at our company in like 5 months. And he was about 75 yrs old.. Lifetime trucker. Wrecked trucks everywhere he went and was employed all his life. Probably still driving unfortunately. Pay the lawyer to bribe the system on your behalf and advance to your next mistake like everyone else.

    People get killed from speeding down grades. He saw you were approaching too fast. You need to slow before the grade some. At least look like you are paying attention.
    All that cop saw was another fatality. He did right

    If you get it reduced to a lesser charge doesn’t it still show up bit say it was plead down?

    The OP knows the ticket was justified. Let's quit beating a dead horse and look for ways to answer her original question.
    I'd look for a lawyer but I wouldn't expect much. That big of a ticket isn't going to get much sympathy from the court.
