I looked it up in the CVSA North American Standard Out Of Service Criteria manual. It is not an OOS violation, in fact it’s not even mentioned in the manual.

I wouldn’t knock myself out, but it also depends on how long you’ll be using that trailer.
49 CFR § 571.223 - Standard No. 223; Rear impact guards.

Looks like a good spot to wipe the mud off your boots till you can write it up for repairs..
PE_T, spyder7723, AModelCat and 2 others Thank this. -
some people are problem solvers and get things done. And others put barriers in their own way.PE_T, spyder7723 and magoo68 Thank this.

Or perhaps I have no desire to get a fine or put out of service if I have an inspection. Not only that but this being a drop and hook means after I deliver it, it would be another drivers problem Until it came back with “why didn’t you report this damage”.
I make due and improvise to keep rolling on anything that won’t cost me money or possibly hit my DAC.
Edit:I work for a mega so I don’t have the luxury of ignoring damage to a trailer because there’s always a chance I could be held responsible for it if I don’t report it. I’ve patched holes myself (trailer repair tape for big holes and flex seal for pin holes/seams) however I don’t have a welder (or I’d run a bead)PE_T Thanks this. -
When you drop it send a macro to maintenance.

those cracks are no where close to being halfway across.
drive on. -
That could be a problem because now they’ll want you to take the trailer to a shop. Fleet trailers have so many problems, and you’ll be in the shop every week. Hahaha. Yeah, I know. Time to move on to another fleet.buddyd157 Thanks this.

Not my choice. After sending the company pictures they want it welded now.
No off load, and no drop and hook. -
They’d make me wait for it to be unloaded or I’d be “in trouble” for not reporting it when I found it. I’ve had other problems like this so my first call is always to road service.
