Merging truck is at fault. Failure to yield right of way and/ or illegal merge.
The driver isnt changing lanes, they are "merging". Improper merge would be the ticket or failure to yield right of way.
There is no such thing as "forfeiting right of way".
The ticket would be "failure to yield right of way" or "improper merge".
