    I think part of the problem is, the federal law says one thing, but some states impose more stringent standards at a state level.

    Reviewed the state law and only see references to .08 in the law. Read Section 346.63. There is a section devoted to personal type vehicles, not licenses, and then a later section that discusses CMV. CMV limits match the federal law.

    I would believe it to be the same as other states. Personal type vehicle is .08. CMV is .08.

    However, best advice, don't drink and drive.

    All I know is I have all but given up drinking,....I'll drink at he the fish camp in Canada and the hunting shack at home because I don't have to drive anywhere,......

    Other than that I will not drink if I have to work the next day,...And on the weekends I wont even have a beer if I am driving,....

    I probably take it way to seriously but I'm not willing to risk my job over a beer,.....

    As it was explained to me, once you are a CDL holder weather in a CMV or your personal vehicle, you are held to the same standards.
    If anyone knows different, I'm sure we'd all be interested in knowing.

    This is true....
    Once you are a holder of a CDL.....the .04 BAC is enforced at anytime and in any vehicle.....Just like getting into an accident in your 4-wheeler off duty....it affects you no matter what.....

    As a holder of a CDL....you are held to a higher standard......

    Not sure where you are getting your info, but that is not true in Florida. .08 non-commercial, .04 CMV. If a driver blows a .02 or higher, a company is required to suspend them from driving for 24 hours. General rule of thumb is no drinking 4 hours before driving, but that only works if you had a couple drinks. That will not work if you drink a 12 pack and then wait 4 hours. Also, if you've been drinking all night you can still be blowing over .08 in the morning.

    The only way CDL holders are held to a higher standard is that no matter what you are driving, it goes on your MVR. A trucking company (and it's insurer) are not going to care what you were driving when you got your DUI or had an accident. All they care about is you got them. It also doesn't matter what vehicle you are in, any major tickets will go towards the suspension of your CDL.

    Ever hear of a "Pull Notice"???

    Everything a driver does from a speeding ticket to an accident...goes on the record...
    Whether or not it was done in a rig or in their POV......

    I know in Nebraska we have to surrender our regular drivers license when you get a CDL and the only license you can carry or use is you CDL... So, if you get pulled over the officer will ask for your license, regitration and insurance... So before you blow they will know if you are a CDL holder or not.

    Also, I now of 2 drivers who's CDL was suspended because they were above the .04 although below the .08. They were both in their personal vehicles. Because they were under the limit for a non cld, it was only the cdl portion they lost... Which was helpful since they need to find new jobs...

    I don't risk it. I would rather error on the side of caution, then be yakking to a judge or soon be former employer that I thought I could drink more since I wasn't driving my truck and was driving my personal vehicle... However, I see myself as a trucker, a professional driver even when I am home and driving my POV.
