    Then i would encourage you to not respond and have a peaceful day indeed. And being that it is a legal issue that has the potential to be ever changing, an updated one does not hurt anyone.

    If a company pays you as a W2 employee they also have to pay FICA, FUTA and SUTA taxes. They also must pay for worker compensation which can be very expensive. If they pay you as 1099 then they avoid all those liabilities. The IRS has very specific rules for each industry as to who must be paid in what way. It's not something an employer can just choose.

    As a company driver, I have per diem. It is not "paid" though. The weekly amount is not taxed. Lmk if this makes sense?
